III III III I II IIII III Doc Date:12/11/2001 <br />1 sss <br />~j~ PART 785 - REQUIREMENTS FOR PERMITS FOR SPECIAL CATEGORIES OF MINING <br />' (°° Section 785.15 Steep slope mining. <br />(a) This Section applies to any persona who conducts or intends to <br />conduct steep slope surface coal mining and reclamation operations, <br />except -- <br />(1) Where an operator proposes to conduct surface coal mining and <br />reclamation operations on flat or gently rolling terrain, leaving a <br />plain or predominantly flat area, but on which an occasional steep elope <br />is encountered as the mining operation proceeds; <br />(2) Where a person obtains a permit under the provisions of Section <br />785.14; or <br />(3) To the extent that a person obtains a permit incorporating a vari- <br />ance under Section 785.16. <br />(b) Any application for a permit for surface coal mining and recla- <br />mation operations covered by this Section shall contain sufficient <br />information to establish that the operations will be conducted in accor- <br />dance with the requirements of 30 CFR 826.12. <br />(c) No permit shall be issued for any operations covered by this Sec- <br />tion, unless the regulatory authority finds, in writing, that 1n addi- <br />tion to meeting all other requirements of this Subchapter, the operation <br />will be conducted in accordance with the requirements of 30 CFR 826.12. <br />Kerr Coal will not conduct any surface coal mining and reclamation <br />operations on "steep slopes", as that term is defined in 30 CFR <br />701.5. Slope measurements for the mine plan area are shown on Map <br />34, Kerr Coal Mine Area Premining Topography and Map 35 Kerr Tipple <br />Area Premining Topography. The general slopes in the mine plan <br />area range between 0° and 17°. Since no slope exceeds 20° the <br />provisions of CFR 785.15 are not applicable to Kerr Coal's opera- <br />tions. <br />785-1 <br />
