r <br />Steve Shuey - 2 - December 24, 2002 <br />10. The commitment added to Exhibit G to release water impounded in the gravel <br />pit, within a maximum of 72 hours after impoundment, should address concerns <br />of the State Engineer's Office <br />11. The Division of Wildlife's letter dated September 24, 2002 has one statement <br />that could be considered a concern the Operator could address. That statement <br />is "If possible, winter haul operations should be limited to one-half hour after <br />sunrise to one-half hour before sunset or non-existent". The DOW's concern is <br />addressed in Exhibit H. <br />12. A spring application of herbicide, for control of Russian Knapweed, was added to <br />the proposed weed control plan located in the vegetation section. <br />13. No response required. <br />14. The required county zoning and land use permits are in the process of being <br />approved. <br />15. The minimum inside diameter of the tanWculvert is about 7-feet. This is a much <br />larger diameter than the size specified in the access road agreement signed by <br />Mark Ragsdale. <br />16. Anew damage agreement for the William's fences is enclosed. <br />17. A revised engineering evaluation is provided for the DeJohn Fence.
