6.4.3 EXHIBIT C -Pre-mining and Mining Plan Maas) of Affected Lands <br />A list and map of all immediately adjacent and nearby owners of record is presented in this section <br />and on Exhibit C-3. <br />The name and location of all creeks and roads aze shown on the Index Map presented in Exhibit B. <br />The Index Map is a portion of the Redvale, Colo. 7.5 Minute Quadrangle Map, Township 45 <br />North, Range 14 West, N.M.P.M. <br />There are no known oil and gas wells in the vicinity of the permit azea. <br />There is a 69 kV power transmission line which runs in a northwest to southeast direction across <br />the mining azea. The power line is owned by San Miguel Power Association. San Miguel Power <br />Association has provided the Operator with design requirements to be included in the mining plan <br />for this size and type of transmission line. An undisturbed azea azound each pole of a diameter of <br />at least 20 feet with slopes developed a[ 2h:ly is provided in the pit design. Additionally, a 15 <br />foot wide access ramp with a maximum 15% grade will be provided at each pole. Aground <br />cleazance restriction of 23 feet (adjusted for voltage and altitude) under the power lines is also met <br />in the mining plan. These measures will assure that the integrity of the power line is not <br />jeopazdized by the mining operation. <br />A large irrigation ditch, know as the Gurley Ditch, lies to the east of the permit area. A 50 foot <br />wide buffer zone between the centerline of the irrigation ditch and the pit disturbance is <br />incorporated in the mining plan. The access road for the gravel pit will cross the Gurley Ditch <br />along the south line of the permit azea. This crossing will be over an existing lazge diameter <br />culvert. This culvert is approximately 195-feet long and is constructed of a series of 8-foot <br />diameter steel tanks. A stiffening ring was left when the ends were cut out of the tanks. The <br />resultant minimum inside diameter of the tanks is approximately 7-feet. Agreements with the <br />irrigation ditch owner (Farmers Water Development Company) to mine within 50 feet of the <br />centerline of the ditch and cross the ditch is presented in Exhibit S. Should leakage become a <br />problem, the Operator will line or pipe the ditch along the east boundary of the disturbed area. <br />Fences along the south line of the permit boundary include a bazbed wire fence and an 8-foot high <br />game fence. The game fence is owned by Tom Farmer. The barbed wire fence is owned by Tom <br />Farmer and adjacent property owner Allen or Williams depending on the location. There is a fence <br />that separates the Allen/Williams property that runs through the permit boundary in an east west <br />direction. Allen owns a fence that meanders along the north side of the permit boundary. This <br />fence is located south of the Allen/DeJohn property line so it is owned by Allen. Allen also owns <br />a fence that meanders in a north south direction trough the proposed disturbed area. DeJohn <br />owns a fence that touches the north line of the permit boundary. <br />There aze three fence owners within 200 feet of where the pit access road intersects County Road <br />37.00. A Williams fence parallels County Road 37.00 to the north. The Fatmer Fences Pazallel <br />County Road 37.00 to the south. The McCallan Fence is located to the east of County Road <br />37.00. <br />Agreements with the fence owners Marilyn Allen and Lila Williams will allow the Operator to <br />remove and replace their fences as necessary to facilitate the mining operation.
