Page 9
ISSUES NOT PERTAINING TO A SPECIFIC EXHIBIT
1. "There is no adequate plan. to control the spread of leafy spurge to locations off the mine site."
(Fremont Co. Weed, Advisory Bonrd, Fremont Co. S.C.D.)
Response -The applicant developed a plan to control leafy spurge. The individuals providing this
comment are satisfied with the operator's plan.
ISSUES RAISED AFTER THE INITIAL COMMENT PERIOD
(During the Informal Conference and Amended Application Comment Periods)
Application Exhibit D -Mining Plan:
1. "What will prevent metals and mining debris from going into the Arkansas River?"
(J. & L. Clark, M. Wilson, R. Dodd, N. Dodd)
Response - The Division assumes the individuals who submitted this comment are referring to
dissolved metals. Metals can not be mobilized (dissolved and moved with ground or surface water),
unless the pH of the water is 5.5 or less. The pH of the area ground and surface water ranges from pH
6.5 to pH 9.
2. "There is a fault line in the immediate area that might adversely affect the Flow of the river. Rivers
have been known to disappear when fault line disturbances occur."
(G. Glab, M. Glnb)
Response - There is nothing proposed in the applicant's plan that would cause disturbance [o a fault
line.
3. "There is real concern about the blasting destroying local aquifers and cutting off water to dozens of
household wells."
(G. Glnb, M. G/ub, B.B. Kreiger, M. L. McGh~nn)
Response -Since it would take energy many magnitudes greater than any planned by the applicant to
destroy aquifers, the Division has no concerns related to this issue.
4. "IVo current dimensions of the sandstone quarry were given in the re-submitted (amended)
application?"
(M. Brown, J. Brox•n)
