Page 10 <br />Response -The Division requested that the operator supply the dimensions of the existing sandstone <br />quarry, in relation to the area planned for the sandstone quarry, in order to determine whether the <br />applicant will be re-affecting previously mined land and, therefore, assuming reclamation liability for <br />that area. The applicant has indicated that the operation will affect the entire area marked for the <br />sandstone quarry. Therefore, [he applicant will be responsible for reclamation of the entire quarry <br />area. <br />5. "Any construction involving the wetlands area of Tallahassee Creek must take place during the colder <br />winter months to avoid the disastrous results that would occur during the flash flooding that warm <br />weather brings." <br />(M. Brox~n, J. Brown) <br />Response -The operator plans to construct the bridges when the stream bed is dry. Construction <br />activities in wetlands will be regulated by an Army Corps of Engineers' nationwide permit. <br />6. "Storm water going over the crossing structure proposed by [he applicant would wash it out and it <br />would be carried into the Arkansas River." <br />(M. Brown, J. Brown) <br />Response -Under the applicant's stormwater protection plan, the bridges are designed to handle a <br />]0-year, 24-hour storm event, plus an additional 0.5 inches of rainfall during such an event. The 0.5 <br />inches adds an additional 25% more rainfall to the 10-year event for the area. Overtopping would <br />most likely not occur, unless precipitation event exceeded the 10-year event by more than 0.5 inches. <br />"The 200 feet right-of-way in which the applicant is referring to, is actually a railroad easement that <br />is measured from the center of the tracks and 100 feet to each side of the tracks. The applicant's fence <br />line lies 50 feet into the railroad easement." <br />(M. Brown, J. Brown) <br />Response - If application approval is granted, the applicant will be responsible for maintaining <br />disturbances within the permit boundary on his property. Any off-site disturbances would be <br />considered a violation of the Mined Land Reclamation Act, and the applicant would be subjected [o <br />civil penalties and/or corrective actions, in addition to recourse by the landowner. The application <br />mining plan shows the southern permit boundary to be the property line between the railroad <br />right-of-way and Agile Stone Systems' property. <br />8. "I am worried about possible ground contamination from the refueling and possible over filling of [he <br />gas tanks on their mobile equipment." <br />(M. Brown, J.
