(See <br />attached letter dated June 22, 2000. The Division identifred two primary impacts, the <br />first is the increase in activity and the loss of habitat as the site is mined. They <br />recommend four (4} means of mitigation, two of which have already been addressed, <br />1) they recommend a setback to the newly graded road on the western boundary which <br />is already part of this proposal. 2) They recommend mining from east to west The <br />applicant consultants and the applicant agree to keep the mining activity moving from <br />west to east increasing the distance from residences over time. 3} Moving the egress <br />road on the south and east. 4} Control of noxious weeds, which will be addressed <br />through a weed management practice agreed upon by appropriate agencies. Staff <br />recommends that all outstanding concerns by the DOW be addressed prior to any <br />approval of this application. <br />h. Ensure that the amenities provided adequately enhance the quality of life in <br />the area, by creating a comfortable and aesthetically enjoyable environment <br />through conventions such as, the preservation of mountain views, the creation of <br />landscaped open areas, and the establishment of recreational activities. <br />There are no requirements for on-site amenities with a mining operation in an <br />agricultural area. <br />h. Enhance the useable open space in Arapahoe County and provide sufFreienf <br />unobstructed open space an recreationa! area to accommodate a project's <br />residents and employees. <br />There are no requirements for open space with a mining operation in an agricultural <br />area. <br />Mineral Resource Area <br />This application is subject to the Mineral Resource Areas Regulations for Areas of <br />Special Interest (Section 1, Subpart D -Areas and Activities of Special Interest). The <br />purpose of these regulations are to protect and administer mineral resources within <br />Arapahoe County in accordance with State Regulations (See Section 101.01.41 for <br />details.) <br />This proposal is governed by Section 101.01.05(2), which regulates applications for <br />"development of a mineral resource area without the intention of exploration or <br />extraction of minerals," The applicant is required to provide evidence that the <br />development plan will present no obstacle to extraction of the mineral resource on or <br />under the subject property or evidence that the proposed development will be of a <br />greater economic value than the minerals present. <br />The subject site is identified as having a lignite deposit approximately 30 feet below the <br />surface as shown on the Arapahoe County Mineral Resource Map.
