DISCUSSION <br />Staffs review of this application includes a comparison of the project to policies and <br />goals outlined in the Comprehensive Plan, a review of pertinent zoning regulations, a <br />plan analysis and an analysis of referral comments. The conclusions made by staff are <br />as follows: <br />f. The Comprehensive Plan <br />The property is located in the Rural Planning District of the Comprehensive Plan. The <br />Rural Planning Area contemplates the preservation of agriculture which this application <br />supports. Specific policies address the preservation of "highly productive soils" for <br />agricultural production and the protection of mineral resource areas, which this <br />application supports. The mining operation will have a positive benefit to the <br />agricultural production in that the excavation and leveling will improve the drainage and <br />soil quality. The operation does not preclude any mining of the mineral resource, <br />specifically lignite, which is found beneath the surface (see the next Section for more <br />details.) <br />2. Regulatory Review and additional Background Information <br />This proposal has been analyzed against the criteria for a Use by Special Review <br />application in Section 6, Part III of the Zoning Regulations and Section 1, Subpart D- <br />Areas and Activities of Special Interest. The following outlines the analysis: <br />a. Recognize the limitations of existing and planned infrastructure by thoroughly <br />examining the availability and capability of water, sewer, drainage and <br />transportation systems to serve present and future land uses. <br />E. Quincy Avenue is paved at the intersection to this property. No further road <br />improvements are required. Water for personnel, dust control and other purposes will <br />be transported onto the site. Portable toilets on-site will be provided as required for the <br />workers. The mobile truck scale is battery-operated and therefore electrical power will <br />not be required. Portable lights will be used during the hours past daylight for safety of <br />employees working past normal daylight hours. All lights will be turned off at the end of <br />the day (6 p.m). <br />The impacts of lighting were discussed on the June 26'^ meeting. Concerns relating to <br />the impacts on adjacenf homeowners and wildlife were identified. The USR document <br />indicates that there wit! be no permanent lighting, portable /ights wilt be used past <br />daylight hours for production, maintenance or farming activities for safety purposes and <br />al! lighting will be turned off at the end of the day, defined as 6 p.m. (See attached <br />document /or details) Adjacent property owners request that there be no lighting for <br />this operation.
