Section 816.65 (a) Continued. <br />(iii) a complete written report o; blasting at night is filed by the <br />person conducting the surface mining activities with the regulatory <br />authority not later than 3 days after the night blasting. The report <br />shall include a description in detail of the reasons for the delay in <br />blasting including why the blast could not be held over to the next day, <br />when the blast was actually conducted, the warning notices given, and a <br />copy of the blast report required by Section 816.68. <br />Energy Fuels will conduct all blasting during daytime hours between <br />sunrise and sunset. Blasting shall occur between the hours of 8:30 <br />a.m. to 9:00 a.m., 9:30 a.m. to 10:00 a.m., 10:30 a.m. to 11:00 <br />a.m., 11:30 a.m. to 12:00 noon, 12:30 p.m. to 1:00 p.m., 1:30 p.m. <br />to 2:00 p.m., 2:30 p.m. to 3:00 p.m., and 3:30 p.m. to 4:00 p.m. on <br />Mondays through Saturdays. <br />Warnings and notices of unscheduled blasting between sunset and <br />• sunrise that cannot be delayed until the next day due to unavoid- <br />able hazardous conditions will be provided according to the requir- <br />ements of 30 CFR 816.65. Oral notices will be provided to persons <br />within one-half mile of the blasting site prior to any blasting <br />which must be conducted between sunset and sunrise. A complete <br />azitten report of blasting at night describing in detail the <br />reasons for the delay in blasting including why the blast could not <br />be held over to the next day, when the blast was actually conducted, <br />the warning notices given and a copy of the blast report will <br />be filed by Energy Fuels with the regulatory authority not later <br />than 3 days after the night blasting. <br />(b) 3lasting shall be conducted at times announced in the blasting <br />schedule, except in those unavoidable hazardous situations, previously <br />approved by the regulatory authority in the permit application, where <br />operator or public safety reouire unscheduled detonation. <br />•~ <br />816-76 <br />
