• <br />Section 616.64 (c) Continued, <br />(2) If there is a substantial pattern of non-adherence to the published <br />blasting schedule as e•aidenced by the absence of blasting during scheduled <br />periods, the regulatory authority may require that the person who conducts <br />the surface mining activities prepare a revised blasting schedule accor- <br />ding to the procedures in Paragraph (c)(1) of this Section. <br />Before blasting in areas or at times not described in a previous <br />schedule, Energy Fuels will prepare and publish a revised blasting <br />schedule. The revised schedule will be promptly mailed to residents <br />or owners of dwellings within one-half mile of the permit area, as <br />well as to local governments and public utilities. <br />If the regulatory authority requires a revised blasting schedule <br />due to substantial non-adherence to the previous schedule, Energy <br />Fuels will prepare and publish such a schedule. <br />•~ Section 816.65 Use of explosives: Surface blasting requirements <br />(a) All blasting shall be conducted between sunrise and sunset. <br />(1) The regulatory authority may specify more restrictive time periods, <br />based on public requests or other relevant information, according to the <br />need to adequately protect the public from adverse noise. <br />(2) Blasting may, however, be conducted between sunset and sunrise if: <br />(i) a blast that has been prepared during the afternoon must be delayed <br />due to the occurrence of an unavoidable hazardous condition and cannot <br />be delayed until the next day because a potential safety hazard could <br />result that cannot be adequately mitigated. <br />(ii) in addition to the required warning signals, oral notices are <br />provided to persons within one-half mile of the blasting site; and <br />., <br />/ 816-75 <br />
