Section 816.49 (g) Continued. <br />surface stability, will be removed. Inspection of all impoundments <br />for compliance with the provisions of this paragraph will be performed <br />simultaneously by the person inspection impoundments as described and <br />referenced in the discussion under 30 CFR 816.46 (q)(4). In addition <br />to a regular maintenance program, such a person will be able to re- <br />commend any additional maintenance required. <br />(h) A11 dams and embankments that meet or exceed the size or other <br />criteria of 30 CFR 77.216(a) shall be certified to the regulatory <br />authoriTy by a cualified registered professional engineer, immediately <br />after construction and annually thereafter, as having been constructed <br />and/or maintained to comply with the requirements of this Section. A11 <br />dams and embankments that do not meet the size or other criteria of 30 <br />CFR 77.216(a) shall be certified by either a oualified registered profes- <br />sional engineer or a registered land surveyor, except that all coal <br />processing waste dams and embankments covered by 30 CFR 816.91-816.93 <br />• shall be certified by a qualified registered professional engineer. <br />Certification reports shall include statements on -- <br />(1) Existing and required monitoring procedures and instrumentation; <br />(2) The design depth and elevation of any impounded waters at the time <br />of the initial certification report or the average and maximum depths <br />and elevations of any impounded waters over the past year for the annual <br />certification reports; <br />(3) Existing storage capacity of the dam or embankment; <br />(4) Any fires occurring in the construction material up to the date of <br />the initial certification or over the past year for the annual certi- <br />fication reports; and <br />(6) Any other aspects of the dam or embankment affecting stability. <br />Compliance with the requirements of this Section is prescribed under <br />Section 780.25.
