Section 816.49 (h) Continued. .~ have had designs certified and will be constructed and maintained according to the criteria set forth in references cited in this paragraph, which criteria and certifications include statements on existing and required monitoring procedures and instrumentation; design depth and elevation of any impounded water at the time of the original certification report or the average and maximum depths and elevations of any impounded waters over the past year for the annual certification reports; existing storage capacity of the dam or embankment; any fires occurring in the construction material up to the date of the initial certification or over the past year for the annual certification reports; and any other aspects of the dam or embankment. .? (i) Plans for any enlargement, reduction in size, reconstruction, or other modification of dams or impoundments shall be submitted to the regulatory authority and shall comply with the requirements of this Section. Except where a modification is required to eliminate an emergency condition constituting a hazard to public health, safety, or the environment, the regulatory authority shall approve the plans before modifica±ion begins. Plans for any modification of any dams or impoundments will be sub- mitted to the regulatory authority and no modification c:ill begin until approval of the plans has been granted by the regulatory authority, unless such modification is necessary on an emergency basis where public health, safety or the environment would be en- dangered. Any such plans will be prepared and certified by a registered professional engineer and will comply, where applicable, with all provisions set forth in 30 CFR 77.216, 816.46, and 816.49.
