Section 816.49 (h) Continued. <br />.~ <br />have had designs certified and will be constructed and maintained <br />according to the criteria set forth in references cited in this <br />paragraph, which criteria and certifications include statements on <br />existing and required monitoring procedures and instrumentation; <br />design depth and elevation of any impounded water at the time of <br />the original certification report or the average and maximum depths <br />and elevations of any impounded waters over the past year for the <br />annual certification reports; existing storage capacity of the dam <br />or embankment; any fires occurring in the construction material up <br />to the date of the initial certification or over the past year for <br />the annual certification reports; and any other aspects of the dam <br />or embankment. <br />.? <br />(i) Plans for any enlargement, reduction in size, reconstruction, or other <br />modification of dams or impoundments shall be submitted to the regulatory <br />authority and shall comply with the requirements of this Section. Except <br />where a modification is required to eliminate an emergency condition <br />constituting a hazard to public health, safety, or the environment, the <br />regulatory authority shall approve the plans before modifica±ion begins. <br />Plans for any modification of any dams or impoundments will be sub- <br />mitted to the regulatory authority and no modification c:ill begin <br />until approval of the plans has been granted by the regulatory <br />authority, unless such modification is necessary on an emergency <br />basis where public health, safety or the environment would be en- <br />dangered. Any such plans will be prepared and certified by a <br />registered professional engineer and will comply, where applicable, <br />with all provisions set forth in 30 CFR 77.216, 816.46, and 816.49. <br /> <br />Section 816.50 Hydrologic balance: Ground water protection. <br />(a) Backfilled materials shall be placed so as to minimize contami- <br />nation of ground water systems with acid, toxic, or otherwise harmful <br />816-55 <br />
