be reclaimed, and furthermore, these ponds must be removed and reclaimed
• at some future date causing the area to be once again disturbed.
because the overall area is quite small and re-disturbance at a future
time would cause almost as much "damage", the Bear Coal Company
respectfully requests that an exemption from sedimentation ponds be
granted by the Division ~s stated in the Rule 2.05.4 requirements.
The area to be reclaimed at the Bear No. 1 and 2 Mine is extremely small
(about acres) and is relatively level. The amount of sediment to be
generated following reclamation will be low given the present
' reclamation plans. The Bear Coal Company will be using straw mulch on
the. site to prevent any erosion. Likewise, straw bale dikes will be
placed at appropriate runoff locations to provide temporary
sedimentation control and to submit the mulching. Re-establishment of
vegetation in the valley area should be fairly rapid, thereby quickly
reducing sedimentation potential.
• (3) The two existing culverts are indicated on the attached Reclamation
Plan Map, (Map 1). As stated previously, both culverts will be removed
once final reclamation is started.
i
_z_
