• <br />Y RESPONSE - BEAR N0. 1 AND N0. 2 MINE <br />PONDS. IMPOUNDt4ENTS AND DIVERSIONS-RULE 2.05.3(4 <br />(1) The reclamation plans of the Bear Coal Company do not call for any <br />permanent diversions. As indicated on the Reclamation Plan Map (Map 1), <br />the temporary diversion of the drainage around the ARCO revegetation <br />test plot will be fully reclaimed to its natural drainage pattern during <br />reclamation. <br />All culverts, surface facilities, and roads will likewise be properly <br />reclaimed. <br />(2) As the Division is aware, a major highway construction project is <br />planned to take place on the North Fork of the Gunnison beginning in <br />early spring of 1982. As discussed previously with individuals at the <br />Division, reclocation of Colorado Highway 133 will bring the highway <br />• through a major portion of the Bear No. 1 and 2 loadout facilities. <br />Also, with the road relocation, the North Fork of the Gunnison River <br />will be moved closer to the Bear No. 1 and 2 facilities area. <br />The planned highway and river relocation are' indicated on the <br />Reclamation Plan Map (Map 1). As discussed with the Division, <br />relocation of the highway will cause the removal of Bear Coal Company's <br />Sedimentation Pond No. 1. With the relocation of the North Fork of the <br />Gunnison River, Sedimentation Pond No. 2 will likewise be essentially <br />removed. Sedimentation Pond No. 3 which handles runoff from the Bear <br />No. 2 portal area will not be affected by the highway construction or <br />river relocation. <br />Current plans call for completion of reclamation at the Bear No. 1 and 2 <br />facilities by late summer and early fall of 1982. Given the highway <br />construction, river relocation, and sedimentation pond removal, the Bear <br />• Coal Company realizes that remaining working space in the area will be <br />greatly diminished. Re-construction of sedimentation ponds will only <br />serve to create additional disturbance and limit the amount of area to <br />-1- <br />
