The video log will be used by Public Works to <br />determine the extent of repairs required. <br />12. The applicant shall be responsible for all traffic control during roadway repairs required in <br />Condition No. 10. Prior to commencing any roadway repairs, the applicant shall submit a <br />traffic control plan to Public Works which has been prepared by a traffic control supervisor <br />certified by the American Traffic Safety Services Association, Inc. No roadway repairs will <br />be started prior to approval of the traffic control plan by Public Works. <br />13. Prior to commencing any road work repairs, the applicant shall show evidence of a valid and <br />in-force Bodily Injury and Property Damage Liability Insurance Policy, with minimum limits of <br />six hundred thousand dollars ($600,000.00) per occurrence and 1.2 million dollars <br />($1,200,000.00) general aggregate. Such policy shall be for the protection of the County <br />from all suits, actions, or <;laims of any type for injuries or damages allegedly sustained by <br />any person or property ors the premises or as a result of the operations of the work. Such <br />policy shall specifically cover the acts and operations of any subcontractors or independent <br />contractors of the applicant in addition to the applicant's employees or agents. <br />14. Special Use Permit No. 97-09 shall be approved for a total mining area to include the <br />described 2401 acres as identified in the vicinity map and mine area plan, herein attached as <br />Exhibit Nos. 2 and 3. The Speciaal Use Permit Area shall be that area where actual mining <br />takes place and shall coincide with the bonded area as described within the Mined Land <br />Reclamation Board (MLR.B) authorization 112 Permit, a copy of which shall be filed with the <br />Department of Planning and Development. The mineral extraction and processing activities <br />authorized under Special Use Permit No. 97-09 shall be permitted only within the acreage <br />which is described and regulated under the Reclamation Bond as identified by the MLRB <br />Permit, and regulated through the State of Colorado, Department of Natural Resources, <br />Mined Land Reclamation Division, except that the combined area of mining, processing, and <br />stockpiling activity and reclamation activity area shall not exceed sixty (60) acres at any <br />given time. Additional mining activities upon lands within the described 2401 acres, but not <br />covered by the financial ;assurance bond associated with the MLRB Permit, or additional <br />acreage to be placed into mining or reclamation under the approved MLRB Permit, in excess <br />of the stated maximum limit of sixty (60) acres, would_ require an amendment to this special <br />use permit. <br />15. The applicant shall file a copy oi' their Annual Mined Land Reclamation Report with the <br />Department of Planning and Development at the time it is submitted to the State of Colorado, <br />Department of Natural Resources, Mined Land Reclamation Division. <br />16. The applicant shall develop, operate, and manage the mining-related activity according to <br />the rules, regulations, plans and permits administered by the applicable federal, state, and <br />local agencies. Any violation of a rule, regulation, permit, or plan may result in the <br />scheduling of a Show/Cause Hearing to consider the revocation of Special Use Permit No. <br />97-09. <br />17. There shall be no blasting permitted in association with the mineral extraction activities. <br />
