Memo to PCPC <br />Re: SUP No. 1997-009 <br />10/12/99 <br />Page 7 <br />18. Special Use Permit No. 97-09 shall be placed on a one-year review <br />NOTE: Section 36(i) of the Pueblo County Zoning Resolution provides that the action or <br />activity authorized by a special use permit must be exercised in full or construction started <br />within one year of the date of the Planning Commission's approval or the special use permit <br />becomes null and void unless the permit is extended by the Commission. Further, the action <br />or activity must be in full compliance with all conditions of the special use permit. Please <br />note that merely obtaining necessary building permits, other local, State, or Federal <br />operating permits, and entering into agreements does not constitute an exercise in full or <br />starting construction. <br />OTHER AGENCY COMMENTS <br />Pueblo County Department of Public Works requested a continuance of this special use permit <br />to provide them more time to re-examine the existing conditions of approval, in light of proposed <br />conditions of approval for another gravel pit operation (Exhibit 4). Public Works has since <br />determined the existing conditions of approval shall stand. <br />Pueblo School District No. 70 stated that trucks shall not haul during the school hours of 7:30 <br />a.m. to 8:30 a.m., and 2:45 p.m. to 3:45 p.m. while school is in session. Given that condition, <br />School District No. 70 does not currently have objections to this special use permit (Exhibit 6). <br />The Colorado Department of Transportation (CDOT) has the following comments (Exhibit 7): <br />1. The proposed Special Use Permit area is approximately two miles south from State - <br />Highway 50C, west of 36'h Lane. Auxiliary lanes are installed at the intersection of State <br />Highway 50C and 36'" Lane. <br />2. An application for access permit would need to be submitted to CDOT for any <br />improvements required as a result of the County's review, for the connection of 36'" Lane <br />and State Highway 50C. <br />3. Drainage from the special use permit area will not affect the state highway right-of-way. <br />COMMENTS <br />Staff visited the property on June 3, 1999 and observed the site was vacant, without visible <br />sign of the proposed activity (Exhibit 5). Livestock were grazing the site.
