The applicant shall submit to the Department of Planning and Development a detailed <br />mining operations plan which identifies the sequence and directions which the mining activity <br />will follow. Said plan may be combined with the above referenced detailed site area plan. <br />4. The applicant shall notify the beneficiaries of any utility easements prior to commencement <br />of any mining activity adjacent to an easement. Applicants sha(I file a copy of this notice with <br />the Department of Planning and Development. <br />5. The applicant will need to maintain valid access easements for this site if the haul route is to <br />cross property not owned by the applicant prior to connecting with the County maintained <br />portion of 36'" Lane. <br />6. The applicant's haul trucks shall not operate on 36'" Lane from 7:30 a.m. to 8:30 a.m., and <br />2:45 p.m. to 3:45 p.m., on days in which school is in session. <br />7. The applicant shall either pave 36`" Lane from the end of the presently paved section of 36'" <br />Lane to the south side of the access to the special use permit site or: <br />The applicant shall contract with a licensed, bonded contractor for the applications of <br />magnesium chloride (a dust palliative) at least twice per year to the portion of 36'" Lane from <br />the edge of the paved section to the south side of the access into the special use permit site. <br />Additional applications of magnesium chloride may be required if deemed necessary by the <br />County Engineer. The rate of application and strength of solution will be specified by Public <br />Works. All costs associated with the application of magnesium chloride shall be borne by <br />the applicant. <br />The applicant shall be responsible for repairing damage to that portion of 36'" Lane, between <br />the applicants' access point and Business Route Highway 50, that occurs during the <br />applicants' hauling period. <br />Upon completion of all mining related activities under this SUP or every six (6) months <br />(during mining activity only), whichever is less, the applicant shall paint a hash mark <br />perpendicular to the centerline of 36" Lane at tenth (0.10) of a mile intervals from Business <br />Route Highway 50 to the applicants' point of access to 36'" Lane. Adjacent to the hash <br />marks, the applicants shall paint the appropriate tenth (0.10) of a mile reading beginning at <br />the Highway 50 south right-of-way line (e.g. 0.1 at the first hash mark, 0.2 at the second, and <br />so on). The Pueblo County Public Works Department shall then videotape the road, at the <br />applicants' expense, from Business Route Highway 50 to the applicants' point of access to <br />36'" Lane. The videotape shall be produced in standard VHS format in such a way and at <br />such a speed that any defects in the roadway surface shall be easily discernible for viewers. <br />This will be the established baseline for all repair requirements. <br />10. The applicants shall repair in good workmanlike manner any damage to 36'" Lane caused by <br />its trucks as determined by the Pueblo County Public Works Department. <br />11. Repairs shall include, but not be limited to, patching potholes and restoring the road to a <br />condition as good as or better than existed prior to commencement of the applicants' <br />
