Special Use Permit No.,1997-G09 shall be placed on a one-year review. <br />NOTE: Section 36(i) of the Pueblo County Zoning Resolution provides that the action or <br />activity authorized by a special use permit must be exercised in full or construction started <br />within one year of the date of the Planning Commission's approval, orthe special use permit <br />Becomes null and void, unless the permit is extended by the Commission. Further, the <br />action or activity must be in full compliance with all conditions of the special use permit. <br />Please note that merely obtaining necessary building permits, other local, State, or Federal <br />operating permits, and entering into agreements does not constitute an exercise in full or <br />starting construction. <br />LOCATION <br />The property is located west of 36'" Lane and south of the Bessemer Ditch, approximately two <br />miles south of Vineland. The property is legally described as a portion of the W1/2 of the SE1/4, <br />the E1/2 of the SW1/4, the SW114 of the NE1/4 of Section 20, and the NW1/4 of the NE1/4 of <br />Section 29, Township 21 South, Range 63 West of the 6`" P.M. (Exhibits 1, 2, 3). <br />BACKGROUND <br />As of the date of this review, the sand and gravel operation has not been established. The site of <br />the requested special use permit contains 240 acres of rangeland. JBCO, the initial applicant, <br />leased the mineral rights to 40 acres belonging to Mr. Bert Hartman, doing business as K.J. <br />Hartman and Company/B.L. 1lartman and Company. The remaining 200 acres belohg to the <br />State of Colorado. The applicants anticipated the property contains 10 to 15 years worth of <br />aggregate reserves. Processing equipment will be moved on site as needed. Except for the <br />area of extraction, the land will be available for grazing. Impact to the public should be minimal <br />at this location. LaFarge, the current applicant, acquired all leases and holdings previously <br />associated with JBCO and Southway Corporation, since the initial application and approval of <br />Special Use Permit No. 1997-009. <br />The Pueblo County Planning Commission approved Special Use Permit No. 1997-009 on June <br />24,~ 1997, with 19 conditions and.one notation.. Staff later deleted one condition inadvertently <br />carried over from another review, and unnecessary to this special use permit. The existing <br />conditions of approval and notation for Special Use Permit No. 1997-009 are: <br />The applicant shall provide the Department of Planning and Development with a copy of any <br />and all Federal, State, or local permit applications, approvals, amendments, or releases <br />(e.g., air quality, MLRB, augmentation, etc.) pertaining to Special Use Permit No. 97-09 <br />within 30 days of submittal and/or approval by the respective agency. <br />2. The applicant shall prepare and submit prior to any mining activity being conducted, a <br />detailed mine-site area plan which identifies the location of all electric utility lines, support <br />structures, and/or gasloil pipelines traversing the permitted property which will require afifty- <br />foot safety buffer either side of the centerline. Said safety buffers shall be identified on the <br />site plan. <br />
