The road between the shop and the north entrance may be left in place, as is, with <br />no modifications, or the road will be removed, and the area scarified and seeded. <br />The approved reclamation plan requires the road to be reclaimed. With a written <br />request from you, and a similar request from Sun Coal Company, the Division can <br />approve retention of the road (Rule 4.03.1(1)(f)(ii)). <br />Without such a request, Sun Coal Company will be required to reclaim the road <br />(Rule 4.03.1(7)(a)). During the July meeting, you indicated that you wanted the <br />road realigned. The Division has no legal authority to require that the road be <br />realigned. <br />3. The Yampa River sediment pond will be removed prior to the end of the liability <br />period, and the azea revegetated, as described in the approved reclamation plan. <br />When the azea is reclaimed, there may be no disturbance until all performance <br />bonds are released. <br />4. The two wells (office trailer and crusher pit) and well houses may be left in place <br />if water rights aze transferred to you. If the water rights are not transferred to <br />you, the well houses will be removed, and the wells sealed. If you wish to retain <br />the wells, you must apply for water rights at the Colorado Division of Water <br />Resources, Office of the State Engineer, 1313 Sherman Street, Room 818, Denver <br />CO 80203. The phone number of that office is (303) 866-3581. The well numbers <br />aze 22689-F and 92725. If water rights have not been transferred by May 31, <br />1993, the Division will instruct Stm Coal Company to seal and reclaim the wells. <br />5. The 1983 settlement agreement indicates that the Yampa River bridge shall <br />remain as a permanent structure. The conveyor gallery attached to the bridge is <br />not addressed in the agreement. The Division will require that the gallery be <br />removed unless it is demonstrated that the gallery is compatible with the approved <br />post mining land use, which is rangeland and wildlife habitat. If you wish to keep <br />the conveyor gallery, please verify that you want the gallery and explain how it <br />would serve your ranching and hay growing operations. <br />6. During the July meeting, you indicated you wanted the crusher pit foundation and <br />building retained as permanent structures to be used in conjunction with your <br />ranching operations. The Division can allow Sun Coal Company to leave this <br />structure in place, provided there is a written request to the Division from you, the <br />landowner. The crusher foundation and building may be retained if you provide <br />the Division with a demonstration that the structure would be beneficial to <br />ranching operations. <br />John A.
