Y ~ ~ <br />Prior to approval of retention of the crusher pit foundation, the Division will <br />require that the foundation structure be covered. As was discussed in July, the <br />open stricture is a potential safety hazard, particularly in light of the sncw;.,obile <br />tours being conducted at the site. Some type of structurally sound cover which <br />secures the entire open portion of the foundation should be installed prior to June <br />1, 1993. If the structure is not covered, the Division will instruct Sun Coal <br />Company to remove the structure, and backfill and seed the azea. <br />7. The ventilation fan for the crusher pit will remain if the crusher foundation and <br />building remain. Removal of the crusher facilities would negate the need for the <br />ventilation fan system. If the structure is removed, the area would be backfilled <br />and revegetated. Reclaimed azeas would be fenced and use of the land prohibited <br />during the liability period. <br />8. Coal fines in the vicinity of the crusher and truck scales will be removed. <br />9. According to our records, in the 1983 settlement agreement it was stated that <br />work in the loadout azea was completed to the satisfaction of you and Sun Coal <br />Company. The Division is in need of clarification of your request for reclamation <br />work at the loadout. If necessary, the Division will require Sun Coal Company to <br />remove the gravel and culverts at the loadout. If culverts and gravel placed at the <br />loadout aze removed, the area will be regraded and seeded. Areas -that are <br />seeded would be fenced off to prevent grazing or other land use during the <br />reclamation liability period. <br />10. You have repeatedly expressed an interest in establishing an airplane landing strip <br />in the meadow north and west of the shop, and have done some 'backdragging" <br />with a bulldozer in that area this year. Sun Coal Company has reclamation <br />liability on a portion of this azea, which is the reclaimed original location of the <br />Yampa River sedimentation pond. According the approved reclamation plan, the <br />area must be revegetated in a manner similar to the mining area, and should not <br />be disturbed for at least ten yeazs. <br />If you will submit to the Division a clear indication of what azea you desire to use <br />for an air strip which also indicates all azeas where heavy equipment work might <br />be performed, the Division can consider redesignating that area of the mine <br />permit. The request for redesignation would have to be initiated by Sun Coal <br />Company. <br />John A. Eilts 3 November 25, 1992 <br />
