S»eeial Notifications - Defttitiom <br />a. Spill: An uttintmtiooal release of solid or liquid materiel which may cause pollution of state waters. <br />b. Upset: An exceptional incident is which there is uaiateatiooal and temporary aoncotttpliaace with permit efftumt <br />limitations because of tutors beyond the reasonable watrol of the pwmittee. An upset does not include <br />noncompliance to the axtmt caused by operational error, improperly designed heaaaent facilities, iaadegttate <br />r.,,.r..,...t fuiiitid, lack of preventative mainteaaace, or careless ar improper operation. <br />3. Norrcanpliance Natifintion <br />a. If, for any wawa, the permiltee does not comply with or will be unable to comply with nay discharge limitations, <br />standards or permit requirements specified is this permit, the permittee shall, at a ~++~*± ~ provide rho Wader <br />t2uality Control Division and EPA with the following information: <br />1) A description of the dischuge and auso of aoncomplimce; <br />2) The period of noncompliance. including exist dates and times and/or the anticipated time whm the disrharge <br />will tmm to wmpliance; and <br />3) Steps being taken to reduce. eliminate. and prevent recurrence of the noncomplying disrharge. <br />b. Tae permittee shall report the following iaatances of noncompliance orelly within twenty-four (241 hours from the <br />time the permittee becomes swore of the noncompliance, and shall mail to the Division a written report wi ~ ve <br />(51 davs after bccomiug aware of the noncompliance: <br />1) Any instance of noncompliance which may endanger health or the environment; <br />2) Any spill or diuharge of oil or other substance which may ceux pollution of the waters of the state. <br />c. TLe petmittee shall report oU other instaacta of non~otrtpliance to the Division within 30 days. Tte reports shall <br />contain Ute information listed in sub-paragraph a. of this section. <br />4. Submission of incorrect or incomplete Wormation <br />Where We permittee failed fq submit any relevant tuts in a permit application, or submitted incorrect information in a <br />permit application or report to the Division, the permittce shall prorr~tly submit the relevant application information which <br />was not submitted or any additional information needed to coax[ nay ertoneous information previously subtrutted. <br />5. ~Ypffi1 <br />'Ihe bypass of trrxtment facilities is gertenlly prohibited. <br />r,. ERed of an Upset <br />An upset constitutes an affirmative defeax to m action brought for noawmpliatrce with permit limitations and <br />requirements if the requiretrrents of paragraph b of thin section are root. (No determination made doting <br />administrative review of claims that noowtnpliance was caused by trpset, sad before an action for noncompliance, <br />is final administrative attic t subject m judicial review.) <br />
