Conditior-s Nete4ary for a D®ot-stradon of Upset <br />A permittee who wishes to establish the affirmative defense of upset shall demoostrsb through propery signed <br />contempocmeous operating logs, or other relevmt evidence that: <br />1) An upset occurred and that the permittee can identify the specific caoee(e) of the upset: <br />2) The permitted facility was at the time being ProPeiY oP~~% <br />i 3) The permittee submitted notice of the upset as requited in Part II.A.3. of this permit (l4-hour notiu); and <br />4) The permittee complied with my remedial measures requited order Sxtien 1Y2.7(d) of the federal <br />[egulatiom. <br />c. Minimimtion of Advt7se Lnosd <br />The petmittee shall mks all reasonable steps to minimim my adverse impact to waters of the State resulting from <br />noncomplimce with my effluent limitations specified in this permit, including such acoelersted or additioml monitoring <br />as necessary to determine the aamre and impact of the noncomplying discharge. <br />9. ~teductioo Loss or Failure o[ Treatmart Fadlity <br />Tae petmitttt has the duty to halt or reduce my activity if necessary to maintain compliance with the permit requirements. <br />Upon reduction, lose, or failure of the treatment facility, the permittee shall, to the extent necessary to maintain compliance <br />with its permit, control production, or all discharges, or both tmtil the facility is restored or m altemetive method of <br />treatment is provided. <br />It shall not be a defense for a permittee in m enforcement action that it would be necessary to Cult or reduce the permitted <br />activity in order to maintain compliance with the conditions of this permit. <br />10. ~qr cer l)prration and Meinttutance <br />TLe permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (end related <br />appurteaaaces} which are iasmlled or used by the permittte to achieve wmpliaaca with the conditions of this permit. <br />Props operation and maintenance includes effective performmce, adequate funding, adequate operator smffmg and training, <br />and adequate laboratory and process controls, including appropriate quality assurance procedures. This provision requves <br />the operation of beck-up or auxiliary facilities or simile systems ody when necessary to achieve wmplima with the <br />conditions of the permit. <br />B. RESPONSIBILITIES <br />I.
