Cerlifintion Certification oC SWMP Completion and hnplementatian: For active mining operations existittg on October 1, 1992, the pertnittee shall have implemented and be in compliance with their SWMP as soon as possible but no later than the onttiversary date of their Mined Land Reclamation permit that falls between July 1, 1993 and Lune 30, 1994. TLe petmittee shall submit a letter to the Division by that date certifying this. For ttew active facilities (begiming operations after October 1, 1992), and for all other active facilities applying after ]uly 1, 1993, the S1A'MP shall be prepared and implemented prior to applying for coverage under the general permit, and certification of this shall be submitted with the application. For inactive mining operations, applying before July I, 1994, the pertirittee shall have impleoxoted end be is compliance with their SWMP as soon as possible but no later thaw ]uly 1, 1994. Tae pertnittee shall submit a letter to the Division by that date certifying this. For those applying after July 1, 1994, the SWMP shall be prepared prior to applying for coverage tinder the general permit, sad cetification of this shall be submitted with the application. SWA1P Ceriifitation. Aoy persoW signing a certification of the completion of the SWMP shall include the following language; 'I certify under penalty of law that a complete Stormwater Management Plan, is compliance with this the permit, has been preparul for my facility sad has hew implemented az my facility. Based on my inquiry of the person or persons who manage the system, or those persons directly respoesible for gathering the information, the Stormwater Management Plan is, to the best of my knowledge sad belief, true, accurate, and complete. I am aware that there arc significant penalties for falsely certifying the completion sad iatplemeatatioa of said SWMP, including the possibility of fine and imprisoameat for Imowing violations.' 4. Prohibition of Non-stotmwater Discharge ^. Except as provided in paragraph b, below, ail discharges authorized by this permit shall be composed wordy of s[ormwater.
