The state liability would <br />also add to the cost for removing the silos because of the adjacent <br />power lines and rail track used by West Elk. <br />The best situation for the Division would be to get ARCO to permit <br />the silos, and the Division to reclaim the disturbance around the <br />silos. This would include cleaning up the coal stockpile area, <br />removing the remains of the truck scale, and re-establishing proper <br />drainage control within and around the site. If ARCO does not wish <br />to permit the site, the Division needs to make a decision as to <br />leaving the silos in place. The Division could remove the conveyor <br />system and just leave the concrete silos. At a later date ARCO may <br />decide to permit the silos in the West Elk Mine. By May 1993 I <br />hope to get all of these issues resolved in order to start the <br />reclamation plan. The refuse disposal area is located adjacent to the Hotchkiss <br />Landfill, and has yet to be reclaimed. Reclamation will consist of <br />cleaning out the final trench, grading & compacting the top of the <br />refuse pile, respreading stockpiled subsoil & topsoil and seeding <br />the site. <br />Delta County purchased this site in 1988 and wants to utilize the <br />final trench excavation to dispose of asbestos waste. There has <br />been no contact with Delta County Health Department since 1988 <br />regarding this issue. The Divisions initial response to this <br />request was that the open trench would probably have to serve as <br />the disposal area for excess coal, coal waste and demolished <br />structures. All of the waste materials from the previous <br />reclamation work preformed in 1991 was buried on site. The only <br />remaining use by the Division for the open trench would be to <br />dispose of the silo area coal stockpile and the broken concrete and <br />structural steel from the two storage silos. <br />I plan to contact the Delta County Health Department and find out <br />their current plans on the site before we conduct reclamation. We <br />also need to come to some final resolution regarding the storage <br />silos. If the silos need to be demolished, the trench is the <br />optimal place to dispose of the concrete. All of the material <br />could be hauled to the refuse disposal area and graded out over the <br />top of the existing pile prior to covering the waste with subsoil <br />and topsoil. There would be no disposal charge of the concrete if <br />it were disposed of in this matter. It would be ideal to reclaim <br />3 <br />
