On the west area of the mine site a new subsidence opening has <br />developed by the portal entry no. 1. According to Tom's notes, the <br />opening was already partially caved when the initial portal <br />backfilling was done by the Division. This new feature provides <br />access into the portal entry roughly 20 feet from the original <br />entrance. Due to the obvious danger to human life, this should <br />probably be addressed as soon as possible. The weather conditions <br />on the last inspection did not allow favorable conditions to <br />inspect the mine entry to determine a reclamation plan. I hope to <br />have Tom locate this subsidence feature when we inspect the site in <br />early April. Until then, I will guessestimate the time frame in <br />which this can be completed. I would like to have this area <br />reclaimed under the same bid package as the coal silo area and <br />refuse pile area. The coal silo area is located west of the west mine area and <br />consists of a coal stockpile area, truck dump, truck scale <br />(partially buried), conveyor, and two silos (50'diam. * 175'H.), <br />substation (property of the local utility company), sediment pond <br />& ditches, and a topsoil stockpile. The Division has not conducted <br />any reclamation in this area because of the ownership situation <br />with the silo facility. To date, this issue has not been resolved. <br />The current situation is that Mountain Coal Company (ARCO- West Elk <br />mine) acquired the title to the silo facility. Various letters of <br />correspondence state that ARCO is interested in the facility, but <br />they do not want to permit it at the present time. At one time it <br />has been suggested to ARCO that the Division would reclaim around <br />the silos that would satisfy some of the requirements of the <br />permit, and make the bonding of the facility less costly to ARCO. <br />The demolition of the silos would most likely exhaust the remaining <br />bond money held by the Division. To demolish both silos would cost <br />at a range of $300,000 to $500,000. This would leave no bond money <br />2 <br />
