Engineer's reeponee to the June 26, 1991, well permit filing, and provide <br />a copy of the augmentation plan to show protection of the rights of <br />present users of surface and ground water (2.05.6(3)(a)(ii)). <br />Hydrologic Balance - Rules 2.04.5, 2.04.7, 2.05.3, 2.05.6!3) and 4.05 <br />12. Many of the wells in the monitoring plan are within the subsidence angle- <br />of-draw, and could suffer damage. Modify the ground water monitoring plan <br />in Exhibit 25 to record the total depth of the wells on an annual basis <br />(Rules 2.05.6(3)(b)(iv) and 4.05.13(1)(d)(i)). <br />13. Please discuss EFCI's progress in acquiring flow samples from Magpie Creek <br />and Second Alkali Creek in reeponee to Stipulations 14 and 15, which were <br />added ae permit conditions with the approval of Permit Revision 1, March <br />11, 1991. Monitoring of any flow in these drainages appears to be <br />warranted by the wording in the Findings document. Describe your <br />understanding of the plan and discuss sampling efforts during <br />precipitation events since the issuance of the Permit Revision. <br />14. Please submit designs for Magpie Creek channel in accordance with <br />Stipulation 16. The designs shall include plan views, longitudinal <br />profile, cross-sections and channel protection details in order to meet <br />the requirements of Rule 4.05.4(4). <br />15. Please update the hydrograph in Figure 4 on page 2.04.7-7 to show the last <br />four years of data in response to compliance with Rule 2.04.7(1)(a)(iii). <br />16. Modify the legend on figures 9 and 11 to accurately distinguish between <br />TDS and TSS (Rule 2.04.7(2)(b)(ii)). <br />Toneoil - Rules 2.05.3(51, 2.05.4(21 and 4.06 <br />17. Review the topsoil handling plan on Table 31 page 2.05.3-60R. Analyze <br />1991 and 1992 topsoil salvage information from the waste pile to confirm <br />that salvage projections are being met (Rule 2.05.4(2)(d)). Provide <br />documentation of the analysis which was performed in response to this <br />request. Hodify predictions on salvage depth(s), if appropriate. Staff <br />reading of the plan suggests that topsoil will be removed from 36.2 acres <br />of the refuse pile footprint and replaced on only 34.2 acres. if <br />anything, the replacement acreage should be greater to accommodate the <br />increased surface area from the side elopes. <br />18. Please update the facilities map to show the topsoil stockpile on the top <br />of the refuse pile (M-4). In addition, if it has not already been done in <br />conjunction with TR-13, please put topsoil stockpile L-2 on Hap 13, the <br />Loadout Area Surface and Groundwater Hydrology Map. <br />Vegetation - Rules 2.04.10. 2.06.4(21(el and 4.15 <br />19. Clarify the revegetation suttees standard for woody plants per Aules <br />4.15.7(2)(b), (c), and (d) and 4.15.8(7). The description on page 2.05.4- <br />27 alludes to both a census and a et atistical evaluation. In addition, <br />you may choose to clarify the definition of a shrub if this is nebulous to <br />you. <br />20. Update the Mine Plan, Map 17, to show actual mining in the last three <br />years as well ae EFCI'e plane for the remainder of the permit term (Rule <br />4.20.1(3)). We recommend this map be combined with the map submitted for <br />3 <br />
