In addition, it would be helpful if there was some distinction <br />between Red Arrow and Jack O'Lantern coal. The latter might be clarified <br />through a note on the legend. <br />21. Please update Table 1, page 6, to reflect coal production history between <br />1990 and 1992 (Rule 2.05.2(1)). <br />22. Please modify the affected area projection in Table 2, page 2.03.40 A to <br />reflect the current affected area, ae well ae the affected area through <br />1994 using the current angle-of-draw of 29°. <br />Ponds, Imooundmente. Diversions - Rules 2.05.3 and 4.05 <br />23. The black water pond used for recycling processing plant water, adjacent <br />to Pond 1, appears to fall into the classification of a temporary <br />impoundment per Rule 4.05.9(2). Thus, a number of demonstrations need to <br />be made. The pond needs to be adequately sized to contain the standard <br />volume of water from the processing plant and one-to-three years of <br />sediment from the plant. The pond must either contain the 25- year 24-hour <br />event, like Ponds 2 and 3, or provide a mechanism for discharge (Rules <br />4.05.6(3)(d), (e) and 4.05.6(5)). Show through an ae-built that the aide <br />elopes are no steeper than 0.5(h):1(v) (Rule 4.05.9(6)). If appropriate, <br />prepare a design to get the pond up to specifications, and include a <br />commitment for implementation of that design within a fixed period of time <br />following approval of the Mid-Term technical revision. <br />24. Storms during the summer of 1992 resulted in damage to many armored <br />channels, including the inlets to Pond 4, the inlet to the eastern loadout <br />pond and the Magpie Creek diversion. Evaluate the installations and <br />modify the design as necessary. At a minimum, provide a generic rip-rap <br />installation appendix which provides specifications on rock angularity, <br />composition, size gradation, and on filter blanket specifications per <br />Rules 4.05.3(4) and 4.05.3(7)(a). <br />25. Division files documenting certifications on the construction of ponds is <br />incomplete. Please provide the most recent certifications on all ponds <br />per Rules 4.05.6(10) and 4.05.9(10). The Division has copies of the <br />outlet works certifications from Ponds L1, L2, 4, and 5. If the as-built <br />on the structure results in a change to the hydraulic functioning of the <br />structure, be sure to include a discussion and appropriate documentation <br />that the structure still meets the design criteria found in the <br />regulations. A copy of the Division's guidelines on certifications ie <br />enclosed for your perusal. <br />26. Please include demonstrations for small area exemptions for the twc <br />substations (NO. 1 and No. 2), and the explosives bunker area (Rule <br />4.05.2(3)). <br />27. It appears that Pond 3 impounds water from the Corley Mine well and the <br />discharge of mine inflow water from the 1-North sump. This water is used <br />in the processing plant or is discharged through discharge point 003 ( p. <br />2.05.3-44). Page 2.05.3-45 indicates that Pond No. 3 is a non-discharging <br />pond. Please clarify. <br />Reclamation - Rule 2.05.4, 3.01 and 3.02 <br />28. Statements on pages 2.05.3-17 and 2.05.4-11R leave the impression that the <br />disturbance at the loadout preceded mining, while 2.05.3-57 indicates that <br />Dorchester developed the loadout. <br />a) Please be more explicit about the type and extent of disturbance <br />as well ae the date in which the area(s) were developed for use in <br />coal mining. <br />
