Lecal, Financial and Compliance Information - Rules 2.03 and 2.07.6(2)
1. Please review the identification of Interests section (2.03.4) and confirm
that the information is correct.
2. Pleaee review the surface and mineral ownership information for the
permit area and areas contiguous to the permit area and confirm that
it reflects current conditions per Rules 2.03.4(6) and 2.03.4(7).
3. Pleaee provide documentation that the inhabitants of the Thompson Ranch
area, west of the refuse pile, have knowingly waived their right to deny
mining within 300' measured horizontally of their residence (2.03.7(3)).
4. Update the compliance portion of the permit application, documenting a
list of all violations and cessation orders received in the last three
years at Southfield, Raton Creek and Marr Strip, and their resolution
(Rule 2.03.5(3)).
5. Update the permits section and Exhibit 4 to reflect current NPDES,
Explosive Storage and special use permits (Rule 2.03.10). In
addition, please provide a copy of the Stormwater Plan prepared last
month for the loadout NPDES permit COG - 850006.
6. Current Proof of Insurance should be submitted to be inserted into the
permit application in Exhibit 3 per Rule 2.03.09.
Land Uee - Rules 2.04.3, 2.05.5 and 4.16
Exhibit 21 contains letters written to landowners from your
predecessor, Dorchester, notifying them of the postmining land vee of
the mine site and the loadout. These letters requested landowner
concurrence through signature, but the copies in the permit have no
signatures. Please submit the signed copies or acquire letters that
show that consideration has been given to making the proposed surface
coal mining and reclamation operations consistent with surface owner
plane and programs (Rules 2.05.5 (1)(a)(iii) and 2.06.6(1)(b)).
8. Please re-work Table 3 to include all of the previous underground mining
operations in the mine area. At a minimum, include the Manley Mine, the
Hlackhawk Mine, Honarch No. 4 Mine, Canon National Mine, Double Dick Hine,
Black Diamond Mine, Corley Dine, and the Newlin Creek Mine per Rule
2.04.3(3).
Pleaee revise Map 12 to include areas of GEC surface disturbance per Rule
2.10.3(1)(k).
10. Please revise the appropriate maps to show the location and use of all
buildings on and within 1000' of the proposed permit area per 2.10.3(d).
