STIPULATION NO. 11 <br />THE DIVISION DIRECTS DORCHESTER COAL COMPANY TO SUBMIT A PROPOSED REPORT <br />FORMAT FOR THE REQUIRED SEMI-ANNUAL SUBSIDENCE MONITORING REPORT, WITHIN 180 <br />DAYS FOLLOWING PERMIT APPROVAL. THIS REPORT FORMAT SHALL INCLUDE TABULATED <br />SURVEY MONUMENT AND STRUCTURE LOCATION AND ORIENTATION DATA. SURVEY DATA FOR <br />THE TWO HIGH-RESOLUTION MONUMENT GRIDS SHALL ALSO BE PRESENTED GRAPHICALLY, IN <br />CROSS-SECTION FORM. THE SUBSIDENCE MONITORING MAP SHALL BE AMENDED TO INCLUDE <br />MONUMENT IDENTIFICATION LABELING, IN ORDER TO FACILITATE DATA REPORTING AND <br />ANALYSIS. FINALLY, SEMI-ANNUAL SUBSIDENCE MONITORING REPORT SHALL INCLUDE A <br />SUMMARY COMPARISON OF MONITORING RESULTS AND THE APPLICANT'S PREDICTIONS FOR <br />EACH INVENTORIED STRUCTURE AND THE STREAM CHANNEL OF NEWLIN CREEK. <br />Statue - Terminated <br />The Division approved a semi-annual subsidence monitoring report format in <br />conjunction with the first mid-term, Minor Revision 13, approved December 10, <br />1987. <br />STIPULATION NO. 12 <br />PRIOR TO AFFECTING THE LAND IN THE SOUTHWEST ~ SECTION 23, TOWNSHIP 20 SOUTH, <br />RANGE 70 WEST, THE OPERATOR SHALL SUBMIT RIGHT-OF-ENTRY INFORMATION FROM THE <br />OWNER. <br />Status - Future <br />EFCI has not mined in this area. Staff understands that this lease has been <br />acquired. Please submit it to terminate this stipulation. <br />STIPULATION NO. 13 <br />WITHIN 90 DAYS OF APPROVAL OF PERMIT REVISION NO O1, THE OPERATOR SHALL SUBMIT <br />DOCUMENTATION THAT APPLICATION FOR A WELL PERMIT FOR THE "NORTH DEWATERING <br />WELL" HAS BEEN FILED WITH THE OFFICE OF THE STATE ENGINEER. <br />Status - Terminated <br />EFCI submitted an application for a well permit for the "north dewatering <br />well" to the State Engineer's office on June 26, 1991. The stipulation was <br />terminated on July 3, 1991. During the fall of 1991, EFCI was informed that <br />the application was denied. Mid-Term adequacy question 11 requires EFCI to <br />pursue this issue. <br />STIPULATION NO. 14 <br />PEAK FLOW SHALL BE MEASURED IN MAGPIE CREEK ON A QUARTERLY BASIS AT THE <br />CURRENT MONITORING STATION. DATA ACQUIRED FROM THIS MONITORING SHALL BE <br />SUBMITTED QUARTERLY AND INCLUDED IN THE ANNUAL HYDROLOGY REPORTS FOR THE MINE. <br />Statva - On-coins. westiona about compliance <br />The 1991 AHR indicates that there was no water in Magpie Creek on six sampling <br />dates in six quarters following the issuance of the Permit Revision. It is <br />not clear whether flow actually never existed in the creek during those <br />quarters, or that there was no flow when EFCI did their quarterly monitoring. <br />Question 13 asks EFCI to elaborate on this issue. <br />STIPULATION NO. 15 <br />THE OPERATOR SHALL MONITOR FLOWS IN SECOND ALKALI CREEK 50 AS TO MEASURE <br />MINIMUM AND MAXIMUM FLOWS DURING EACH QUARTER FOLLOWING APPROVAL OF PERMIT <br />10 <br />
