SUMMARY <br />The Renewal Review Process <br />On February 11, 1991 the Colorado Division of Minerals and Geology notified Wyoming <br />Fuels (previous permittee), that the permit, No. C-81-026, would expire December 1, 1991. <br />This notification was given pursuant to Rule 2.08.5(2)(a). This Rule requires that the <br />Division to notify the permitee 270 days before the expiration of permit. The applicant, to <br />be eligible for the right of successive renewal, must submit a renewal application within 180 <br />days of the expiration of the expiration of the permit. The 180 day date for the Canadian <br />Strip Mine was June 3, 1991. The Division received a complete application for a renewal <br />on April 3, 1991, therefore meeting the conditions for receiving the right of successive <br />renewal. <br />The application for renewal was submitted under the name Wyoming Fuels, who later, <br />through the succession of operators process, transferred the existing permit to the Slurco <br />Corporation. The Division received the request for transfer on May 24, 1991 and on <br />December 20, 1991 the Division approved the transfer to the Slurco Corporation. <br />The Division conducted its review of the renewal concurrently with the transfer process. <br />Adequacy review concerns for the transfer were submitted to Wyoming Fuels (Slurco) on <br />June 14, 1991 and on September 30, 1991. All issues were adequately resolved. On <br />December 13, 1991 the Division submitted additional concerns to the permittee; these <br />concerns also have been adequately resolved. <br />Before issuing a renewal of a permit, the Division must conduct a compliance status review <br />of the owners and operators of the mining operation. States where Wyoming Fuels conducts <br />operations were contacted and none reported that Wyoming Fuels has had a permit <br />revoked, bond forfeited or owes outstanding civil penalties. Slurco, Inc. was also checked <br />during the transfer process. As part of the transfer and renewal, a check with the Office of <br />Surface Mining Reclamation and Enforcement (O.S.M.R.E.) Applicant Violator System <br />(A.V.S) was conducted on August 23, 1991 and December 23, 1991, and the O.S.M.R.E. <br />issued a recommendation to approve. The final O.S.M.R.E. recommendation to approve <br />was issued on April 21, 1992. <br />Canadian Strip Mine, C-81-026 4 July 31, 1992 <br />
