<br />Permitting History for Previous Permit Terms <br />On February 11, 1981, Wyoming Fuel Company, a division of Kansas-Nebraska Natural Gas <br />Company, filed an application with the Colorado Division of Mined Land Reclamation and <br />the federal Office of Surface Mining to continue and expand its existing operations at the <br />Canadian Strip Mine site. Permit C-81-026 was issued to the Wyoming Fuel Company for <br />the Canadian Strip Mine on December 1, 1981. <br />On June 28, 1982, the Division received a notice of temporary cessation of mining activities <br />from the Wyoming Fuel Company. No coal has been mined at the mine since then. <br />In accordance with Rule 2.08.5 of the Regulations, the Division notified Wyoming Fuel <br />Company that a permit renewal application was required to be submitted to the Division <br />by June 1, 1986. On June 3, 1986, the Division received a permit renewal application that <br />was deemed incomplete on June 4, 1986. <br />On July 18, 1986 the Division received a second permit renewal application that was <br />deemed complete on August 7, 1986. A preliminary adequacy renew was completed by the <br />Division on September 30, 1986. The correspondence of October 27 and November 24, <br />1986 in response to the adequacy review resolved all the Division's concerns raised during <br />the renewal process. <br />The proposed permit term will expire December 1, 1996. A review of past permit renewals <br />showed that the length of the previous permit term exceeded 5 years. The original permit <br />was issued December 1, 1981 and the expiration date for this permit was the anniversary <br />date plus 5 years, or December 1, 1986. During the renewal Canadian had the right of <br />successive renewal and the renewal date passed. The problem arose because the Division <br />issued the next 5 year permit term from May 16, 1987 and not from December 1, 1986. <br />Thus the right of successive renewal allowed for a greater than 5 year permit term. The <br />Division should have issued the renewal from December 1, 1986. The Division would like <br />to reset the permit expiration date to the original anniversary date of December 1. The <br />permit term for this proposed renewal will therefore expire December 1, 1996. <br />Canadian Strip Mine, C-81-026 5 July 31, 1992 <br />
