With the approval of the Board, reclamation may <br />be accomplished on substitute lands to discharge <br />an operator's permit obligations. <br />SDRETY RE9QIRENENTS <br />The Board is given rather broad discretion in requiring <br />either a bond or some other form of security to quar~antee <br />performance of the reclamation work. The amount is to be <br />based on the cost of reclaiming laada actually disturbed <br />during various stages of the mining operation. Past <br />record of responsibility, financial status and the like <br />are the factors to be considered by the Soard in deter- <br />mining the form of surety to be required or whether the <br />guarantee of a corporate surety bond is to be required. <br />The amount required to be posted can be increased or <br />decreased as appropriate to the progress of the mining <br />operation. Cancellation and substitution procedures are <br />specified. Bonds must be released 15 days after the' <br />Board's failure to inspect the reclamation within 60 days <br />of the filing of a notice of completion. In any case, <br />bonds may not be held more than one year beyond the <br />completion of reclamation. Forfeiture proceedings may be <br />instituted by the Attorney General where there has b~:en <br />noncompliance with the Board's orders. Corporate <br />sureties have the option of reclaiming the land or <br />forfeiting the bond penalty. The Board may reclaim land <br />which has been the subject of a forfeiture; however, <br />forfeited money goes into the state's general fund, <br />thereby requiring a legislative appropriation if the <br />Board is to undertake reclamation work. <br />LIMITED IMPACT OPERATIONS <br />Limited Impact Operations are those affecting less than <br />ten acres where 1@66 than 70,OOO.tone of mineral or <br />overburden are extracted per calendar year. Limited <br />Impact Operations are subject to the same reclamation <br />requirements imposed on all operations; however, BB .L065 <br />provides for a somewhat simplified permit application <br />procedure. A little less information is required, and <br />the fees are reduced. <br />Applications require the operator's name and address, <br />identification of the surface and subsurface owners, a <br />statement as to the size of the operation, a location map <br />showing roads and access to the operation, a description <br />of the type of operation, and a discussion of measures to <br />be taken to comply with the duties imposed on operators. <br />
