Annual reports showing new <br />disturbances and completed reclamation are required. <br />The Board must act on applications for limited Impact <br />operations within 30 days of their having been filed. <br />When a limited impact operation i^ scheduled to exceed <br />the stated size limitations, a regular pertait must be <br />obtained. Procedures for expediting the conversion to a <br />regular permit are provided, and the Board oust act on a <br />conversion application within 90 days. <br />PROSPECTING <br />HB 1065 establishes a system whereby persona engaged in <br />prospecting must notify the Board of their activity. <br />Prospectors must be bonded and they must reclaim the. land <br />they disturb. Prospecting is not subject to permits. <br />The bill defines prospecting as the act of searching for <br />or investigating a mineral deposit. The term includes <br />sinking shafts, tunneling, drilling core and bore holes <br />and other pre-development work. Prospecting does not <br />include activities such as airborne surveying and photo- <br />graphy, the use of hand carried instruments to make <br />measurements and tests, boundary or claim surveying, <br />location work, or any other work causing no greater :Land <br />disturbance than is caused by ordinary lawful use of the <br />land by persons not prospecting. Zn other words, a <Ireat <br />deal of activity thought of as prospecting within the <br />industry will not even be subject to the notice requirement. <br />where notice is requirefl, it must be filed prior to rzntry <br />upon the land. The notice is to contain the applicant's <br />name, a description of lands by township and range, sin <br />approximate commencement date, and a statement of <br />measures to be taken to reclaim the land consistent vrith <br />the duties imposed on operators. All information is <br />maintained as confidential until reclamation work is <br />completed. <br />A bond, in the amount of S2,000 per acre, must be <br />obtained by prospectors. Alternatively, a $25,000 bond <br />covers statewide prospecting. <br />Notice of completion is to be given to the Board within <br />30 days of the termination of operations. The Board will <br />inspect the lands to determine whether reclamation ha.s <br />been satisfactorily performed. The bond must be released <br />within 30 days of completion. <br />
