Exhibit 13-2A is based on May 2004 aerial flight and is the latest post-mining <br />topography map available for comparison with the as-built post-mining <br />topography map (Exhibit B -May 2005 aerial flight). Exhibit 13-2A of the <br />permit application package is still pending approval of TR-37. A discussion of <br />how the post-mining topography map was created should be included in the <br />documentation of the bond release application. It would also be helpful to have <br />the original post-mining topography map or apre-mining topography map at the <br />same scale as Exhibit B. Please submit these with the bond release application if <br />available. Also please add the contour interval to the legend of Exhibit B. <br />12. On page 3 there is no discussion for Attachments B and C. Please include a <br />discussion for these attachments. <br />13. The Guideline Regarding Selected Coal Mine Bond Release Issues (April 18, <br />1995) requires documentation that drainages have been established in accordance <br />with the approved plan. As-built drainage profiles aze provided in Attachment D. <br />The drainage profiles show only the as built. In most cases, the approved profile <br />designs are also included. A discussion regarding the establishment of drainage <br />control should be added to Section II Phase I Bond Release Documentation. If <br />not included in the application, then the location of the approved post-mining <br />drainage control map(s), profiles and design criteria that has been approved in the <br />permit application package should be referenced and described. <br />14. The bond amount requested for release coincides with the most recent cost <br />estimate and it looks reasonable.
