Roy Karo
Seneca Coal Company
April 24, 2006
Page 4
Division will continue to retain performance bond for ponds 004 and 008
until they are approved as permanent impoundments.
The current cost estimate only includes reclamation costs for those
reclaimed stock tanks not approved as permanent (T-l, T-2, T-3, T-5, T-6,
T-7 T-9 T-10 T-11 T-12 T-13 T-15 T-25). Once Phase I bond release has
been approved reclamation costs for those structures can be released. The
Division is not holding performance bond on those stock tanks previously
approved as permanent.
If any of the groundwater wells have been sealed and completion reports
reviewed, the Division could likely release liability through the Phase I
process subject to inspection verification of compliance with Rules and
approved reclamation plan.
OOd - Division concurs, subject to inspection/verification of compliance with the
Rules and approved reclamation plan.
OOe - Division concurs, subject to inspection/verification of compliance with the
Rules and approved reclamation plan.
OOf - OOi Division concurs.
OOj - Once the Division has established which areas are eligible for Phase I
release, we will recalculate the equipment mobilization and
demobilization based on remaining reclamation to be completed. Some
equipment units would no longer be needed, or fewer could be mobilized.
At this point the Division can't put a number on it, so we cannot comment
at this time on SCC's numbers.
Indirect Costs - These would be recalculated based on the
revised/remaining direct costs (after reducing liability for Phase I tasks}
established once we have determined what will be released.
If you have any questions please call me.
Sincerely,
M P. ~~~~
Michael P.
