Roy Karo <br />Seneca Coal Company <br />April 24, 2006 <br />Page 4 <br />Division will continue to retain performance bond for ponds 004 and 008 <br />until they are approved as permanent impoundments. <br />The current cost estimate only includes reclamation costs for those <br />reclaimed stock tanks not approved as permanent (T-l, T-2, T-3, T-5, T-6, <br />T-7 T-9 T-10 T-11 T-12 T-13 T-15 T-25). Once Phase I bond release has <br />been approved reclamation costs for those structures can be released. The <br />Division is not holding performance bond on those stock tanks previously <br />approved as permanent. <br />If any of the groundwater wells have been sealed and completion reports <br />reviewed, the Division could likely release liability through the Phase I <br />process subject to inspection verification of compliance with Rules and <br />approved reclamation plan. <br />OOd - Division concurs, subject to inspection/verification of compliance with the <br />Rules and approved reclamation plan. <br />OOe - Division concurs, subject to inspection/verification of compliance with the <br />Rules and approved reclamation plan. <br />OOf - OOi Division concurs. <br />OOj - Once the Division has established which areas are eligible for Phase I <br />release, we will recalculate the equipment mobilization and <br />demobilization based on remaining reclamation to be completed.
