DOCUMENTATION <br />OF MINE SAFETY AND HEALTH ADMINISTRATION APPROVAL OF DISPOSAL <br />W[THIN UNDERGROUND WORKINGS WILL NEED TO BE PROVIDED, PURSUANT TO <br />RULE 4.11.3. <br />STIPULATION NO. 29 <br />r <br />WITHIN THIRTY DAYS OF PERMIT ISSUANCE, THE OPERATOR WILL SUBMIT A ; <br />PLAN FOR TEMPORARY STORAGE AND FINAL DISPOAL OF NONCOAL WASTES <br />PURSUANT TO RULES 4.11.4(1),(2), AND (3). <br />Stipulation No. 1, Stipulation No. 19, and Stipulation No. 20, attached to the previous permit <br />are no longer included. The operator has incorporated the language of Stipulation No. 1 into the <br />text of the permit application package (PAP). The Resource Recovery and Protection Plan <br />specified by Stipulation No. 20 was submitted in December, 1993, and is included in Appendix <br />E of the PAP. Stipulation No. 21, which approved a sediment drying area adjacent to the <br />sediment pond, was resolved by submittal of required maps in August, 1992. <br />Stipulation No. 19, included in the January, 1992, Findings document had required the operator <br />provide the Division with additional cultural resource survey information for certain areas <br />overlying the area of proposed mine workings, prior to undermuting. The Division has <br />determined the stipulation is no longer necessary, based on a March 5, 1992, State Historic <br />Preservation Officer (SHPO) concurrence with the "no effect" determination made by the Office <br />of Surface Mining Reclamation and Enforcement (OSM), in then January, 1993 "Mining Plan <br />Decision Document" for Federal Leases C-0125437, C-0125515, and C-0125439. Both the <br />rationale for the "no effect" determination and the SHPO concurrence are included in the <br />~~ referenced decision document. Subsequent communication with SHPO has confirmed that Wey <br />do not believe further cultural resource surveys are necessary on the permit area. <br />a <br />
