Locations and design information for <br />diversions and culverts other than those <br />culverts that are not part of a diversion <br />(such as those in the maintenance yard area <br />which are provided to allow for movement of <br />equipment in low-lying areas) need to be added <br />to the permit. <br />During a discussion following the inspection, <br />you mentioned that your interpretation of the <br />regulations was that only structures <br />associated with haul roads were required to be <br />included in the permit. Please note that Rule <br />2.05.3(3)(b) states the application shall <br />contain a description of each existing <br />structure for which there are performance <br />standards specified in the rules. Rules <br />4.05.3(1) and 4.05.3(2) specify performance <br />standards for "diversions and collection <br />drains that are used to transport water into <br />water treatment facilities" and temporary <br />diversions within permit areas. Rule <br />2.05.3(4) also states that each application <br />shall contain a general plan and a detailed <br />design for each diversion "proposed to be <br />constructed within the permit area". <br />Examples of diversions and culverts not in the <br />permit, which the Division is aware of are <br />highlighted on the two figures enclosed with <br />this letter. This is not an all-inclusive <br />list. If these structures are identified <br />somewhere in the permit other than on the <br />hydrology maps, please let us know where that <br />information is located. <br />d. Since past repairs to the inlet of the stoker <br />sediment pond have not proven to be stable <br />and, since the pond design in the permit does <br />not include any information pertaining to the <br />inlet, the permit should be revised to include <br />a design for a stable pond inlet which will <br />handle runoff from the stoker area and the <br />portions of nearby roads which drain into the <br />pond. <br />In order to address the permit defects discussed above, the <br />Division requests that Colowyo submit a technical revision to the <br />permit within thirty days of receipt of this letter. <br />
