Staff research and report to the County Planning Commission as to <br />ownership of Stockyard's Road and recommend conditions, if any, to mitigate <br />additional heavy truck traffic loading to public rights-of-way. <br />To insure that no additional erosion is to be caused to adjacent properties, <br />mining shall not occur within 50 feet of property lines. <br />4. One-year review. <br />Special Use Permit No. 596 incorporating the above special use permits into a single <br />permit was originally approved September 4, 1986, with six conditions. The Planning <br />Commission approved one-year reviews of this permit in 1987 and 1988, and a five <br />year review on August 24, 1993, with five conditions: <br />1. The applicant shall obtain a State Highway access permit for access from <br />Baxter Road and 36`" Lane before these access points are used in the mining <br />operation. A copy of the access permits shall be provided to the Department <br />of Planning and Development within thirty days of issuance. <br />2. The applicant shall access property under SUP No. 596 with heavy <br />equipment (semis, dump trucks, loaders, scrapers, etc.) only via approved <br />accesses from U.S. Highway 50, State Highway 233 (Baxter Road), and <br />State Highway 231 (36`" Lane). <br />3. The applicants shall provide the Department of Planning and Development <br />with a copy of any future MLRB applications, permits, or amendments within <br />thirty days of their submittal to and/or approval by MLRB. <br />4. The applicant shall provide to the Department of Planning and Development <br />a copy of any further State or Federal permit applications (i.e., access, <br />NPDES, 404, etc.) and approval thereof within thirty days of said application <br />or approval. <br />Special Use Permit No. 596 shall be reviewed in five years (August, 1998) or <br />one year after mining becomes fully operational, whichever occurs first. The <br />applicant shall notify the Department of Planning and Development of the <br />commencement of mining activities within thirty days following start-up. <br />Since this five year review in 1993, Valco, Inc., has negotiated a sale of its Pueblo <br />operations and portions of its land to Continental Materials Corporation, which is doing <br />
