<br />based on a finding that the operations wil l comply with all requirements of the Colorado State Program as <br />found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br />Regulationspromulgatedpursuant to the Act. If no request for a formal hearing is made within thirty (30) <br />days of the first publication of the issuance of this proposed decision, then this decision becomes final, <br />and the permit will be issued. The permit application, all supporting documents and any stipulations or <br />conditions will become a binding part of the permit. <br />SUMMARY <br />History of the Review Process <br />I. PermittineHistorv <br />The Colorado Coal Mine No. 1 was initially operated by the Colorado Coal Mining Company (GCMG) <br />under Interim Permit No. 80-59, granted on June 26, 1980. A permanent program permit was applied for <br />on February 9, 1981. In July of 1981, Perma Resources, pazent of Colorado Coal Mining Company, filed <br />a Notice of Exploration (CX-127-0 l ). Mining began in May 1982 under this exploration permit for a test <br />bum. This mining resulted in the removal of approximately 35,000 tons of coal and a total disturbance of <br />73.5 acres. <br />Because of numerous concerns by the Division over surface hydrology and groundwater issues, CCMC <br />modified their proposed mine plan and submitted a "dry mine" plan in December 1982. This plan was <br />approved by the Division as described in the June 16, 1983 Findings of Compliance. A mining permit for <br />coal was issued to Colorado Coal Mining Company for the Colorado Coal Mine No. 1 on March l2, <br />1984. The mining allowed by this permit, however, never occurred. <br />On February 22, 1985, the Director of the Department of Natural Resources was notified by Perma <br />Resources of the acquisition of Kaiser Steel Corporation and the proposed transfer of Perma's subsidiary, <br />Colorado Coal Mining Company, to Kaiser Steel Corporation. Information subsequently provided <br />indicates this transfer took place on Mazch 28, 1985. <br />During the summer of 1986, the Division conducted a midterm review of the permit. In response to the <br />Division's midterm adequacy comments, Kaiser Steel Corporation, having assumed the obligations of the <br />Colorado Coal Mining Company, responded by submitting two sets of reorganized and revised permit <br />documents on December 24, 1986. <br />In accordance with Rule 2.08.5, the Division notified Colorado Coal Mining Company of the need to <br />renew the existing permit on June 3, 1988. The application was received on November 15, 1938, and was <br />approved on August 22, 1989. <br />On January 26, 1989, a technical revision (TR-09) was approved which revised the mine's reclamation <br />
