The Golden Eagle permit application addresses <br />this section on pages 2.05-34 through 2.05-47g, and Exhibit 6, which contains a 1980 report <br />and a 1994 report. Pages 2.05-34 through 47g and the 1994 report have already been sent <br />to you. Information relevant to your situation may be found on, but not necessarily limited to, <br />pages 2.05-34, 2.05-35, 2.05-44, 2.05-47 and 2.05-47a. <br />Annual Hydrologic Reviews of 1991, 1992 and 1993 state that the water seeping from the <br />NW-1 air shaft, not a well, amounted to 20 GPM in 1991, 10 GPM in 1992 and 10_GPM in <br />1993. <br />In the second paragraph of your November 30, 1994 letter to the Division, you asked if there <br />has been longwall mining beneath your property north of Highway 12. Examination of Map 1 <br />and Map 16 of the Golden Eagle permit application show that longwall mining has not occurred <br />beneath your property north of the highway. <br />The Department of Public Health and Environment can update you on the present status of the <br />Cease and Desist Order which they issued on August 29, 1994. Please direct your request to <br />them. <br />Your requests for copies, indicated as paragraphs a., b., c., and d. in your letter, must be <br />handled in a manner consistent with Division policy. Please be aware that copies of the <br />Golden Eagle and New Elk permit applications will be several hundred pages in length. <br />The Division does not have a General Fund. The State of Colorado has a General Fund, which <br />fund receives all revenue generated by the State which is not earmarked for other specific <br />purposes and expenditures. The Coal Program receives 17°,6 of our total program funding from <br />monies in the General Fund through approval of the legislature. Our use and expenditure of <br />funding is set out in yearly budget proposals which are approved by the Governor and the <br />legislature. Once a budget proposal is approved, we can expend monies only in the manner <br />approved. Our General Fund monies are not deposited into an account. Rather, we receive <br />authority to spend our appropriation.
