Long <br />Division Dueanr <br />During the past five weeks we have received a total of ten letters or faxes from you. These <br />letters and faxes have ranged from straightforward requests for Division file research and <br />copying of documents to questions about why the Division took a particular action or arrived at <br />a decision. <br />Anytime you have questions about why the Division took a particular action or arrived at a <br />decision we are happy to respond. However, requests for research of the files and copying of <br />documents contained therein constitutes basic research. The Division has a policy on public <br />review procedures, a copy of which I have enclosed. Fiscal constraints prohibit Division <br />personnel from conducting basic research for any party. During the past month, with the <br />exception of the 50.25/page requirement, I have waived this policy in your case, in order to <br />accommodate you since you appear to be currently based in Houston, Texas. When I initially <br />waived the research prohibition I had no idea of the ongoing nature and extent of your <br />requests. At this point I cannot continue to waive the research prohibition and must <br />respectfully decline to accommodate any further requests for research to be conducted by <br />Division personnel. Rather, I encourage you to review public files at the Division offices or the <br />mine site yourself or to engage the services of a consultant who can do research for you. <br />To assist you I have enclosed a brief list of some consultants who are familiar with our public <br />file review procedures. You may contact them to do further research for you if you wish. The <br />provision of this list does not imply a Division endorsement of any of the parties named on the <br />list. <br />If you would like to discuss this decision please feel free to call me. <br />With regard to your most recent letter received December 5, 1994 (dated November 30,1994), <br />following you will find a response to questions posed in the first and second paragraphs of <br />page one and the second paragraph of page two. <br />In the first paragraph of your November 30, 1994 letter to the Division, you asked for a <br />description of the hydrologic consequences of the water seepage. from the NW-1 exhaust air <br />shaft. The subject of the potential effects of mining on the hydrology within the immediate <br />and surrounding areas is covered by Section 2.05.613) of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining. The Golden Eagle permit application addresses <br />this section on pages 2.05-34 through 2.05-47g, and Exhibit 6, which contains a 1980 report <br />
