SECTION III - STATUS OF STIPULATIONS <br />One Stipulation was attached to the Proposed Decision and Findings of <br />Compliance of May 16, 1988. It read as follows: <br />A PERFORMANCE BOND FOR THE APEX N0. 2 MINE, IN THE TOTAL AMOUNT OF <br />$82,420, PAYABLE TO THE STATE OF COLORADO AND THE UNITED STATES OF <br />AMERICA MUST BE FILED WITH THE DIVISION WITHIN 30 DAYS OF THE DECISION <br />BECOMING FINAL. <br />The appropriate bond was received by the Division on August 26, 1988, and the <br />Stipulation is no longer in effect. No other permit stipulations exist at <br />this time. <br />SECTION IV -PERMIT VARIANCES <br />The Apex No. 2 Mine permit does not involve any variances regarding <br />mountaintop removal or the achievement of approximate original contour. There <br />were no experimental practices allowed at this site. The Division granted a <br />variance to the stream buffer zone requirements of Rule 4.05.18, as discussed <br />in the permit documents. <br />SECTION Y - DECISION TO REQUIRE REYISIONS OR ADDITIONAL INFORMATION <br />Please respond to the following questions and requests no later than February <br />15, 1991: <br />1) Please indicate your plans regarding future operation of this site. If <br />Sunland Mining Corporation does not intend to conduct any further mining <br />activities, then reclamation must be completed. Also, include an update <br />regarding the status of the two coal leases under which the mine operates. <br />2) Review the "Identification of Interests" section of the permit and <br />provide any necessary updates. If updates are not necessary, then <br />specify that the existing information is completely accurate. <br />3) Annual hydrology reports are required under Rule 4.05 .13(4 )(c ). Submit <br />the 1990 Report no later than February 1, 1991, and provide a commitment <br />to meet this requirement in subsequent years. <br />
