.. <br />4 <br />4) Submit a plan to test the on-site substation for PCB content. Please <br />note that the revised financial warranty amount (Section VI) includes <br />costs for testing and final disposal of the substation. The calculation <br />is based on the assumption that the substation contains some amount of <br />PCB. <br />5) Provide a detailed plan, in the form of a minor revision, to ensure <br />compliance with Rule 4.11.4 (Disposal of Non-coal Waste). The plan nest <br />include plans to dispose of all empty barrels, trash, scrap materials and <br />any miscellaneous non-coal waste located at the site. The plan oust also <br />include plans to remove or more securely store the barrels of hydraulic <br />fluids located on-site. Specific schedules nest be provided. A Notice <br />of Violation will be issued, if the plan is not implemented by July 31, <br />1991. Please note that the increased bond calculation includes the <br />removal costs associated with refuse, scrap and fluid disposal. <br />SECTION VI - BONDING SUMMARY AND RECOMMENDATION TO REQUIRE ADDITIONAL BOND <br />The Division currently holds a viable bond, No. 64 S 1005 0789 2 BCA, in the <br />amount of E82,400 (Aetna Casualty and Surety Company). As part of this <br />Midterm Review and as required by Rule 3.02.2, a thorough bond calculation was <br />completed for the site. The specific calculations are attached. We believe <br />that an increased bond must be submitted, with the new amount proposed to be <br />5172,000. This constitutes a considerable increase above the existing amount. <br />The operator is afforded specific rights under Rule 3.02.2 regarding proposed <br />bond increases. Please review this Rule, and review the attached cost <br />summaries. Provide your response and any objections no later than February <br />15, 1991. We will finalize the amount requirement after Sunland Corporation <br />has supplied the requested response. Please understand that the estimate is <br />based upon actual contractor costs incurred as a result of numerous <br />reclamation projects conducted by the State of Colorado, and upon cost <br />estimates contained in the "Means Site Work Cost Data", 1990, 9th Annual <br />Edition, and in the Caterpillar Performance Handbook. <br />
