2 <br />1988. The renewal permit was issued on May 26, 1988, with the new expiration <br />date set at May 26, 1993. <br />The midterm date for this five-year permit term is November 26, 1990. This <br />Midterm Review was initiated in early December of 7990. <br />Since permit renewal, three Notices of Violation were issued. On November 13, <br />1990, Notice of Violation No. C-89-031 was issued for failure to properly <br />maintain the Apex No. 2 Mine drainage control system. The Violation was <br />terminated on May 11, 1990. A total civil penalty of £750 was paid in full. <br />On September 6, 1990, Notice of Violation No. C-90-039 was issued for failure <br />to maintain liability insurance. This Notice was Vacated by the Division <br />Director on September 21, 1990. <br />On October 24, 1990, Notice of Violation No. C-90-055 was issued for failure <br />to conduct required monitoring. The Notice of Proposed Amount of Civil <br />Penalty was received by the operator on November 8, 1990 (Certified Mail <br />Receipt No. P 427 450 661). The Division did not receive a request for an <br />assessment conference; therefore, a Notice and Order to Pay Fixed Penalty was <br />sent on November 23, 1990. The Notice and Order to Pay Fixed Penalty was <br />received by the operator on November 26, 1990 (Certified Mai] Receipt <br />No. P 767 449 492).
