<br />- 16 - <br />The permit application identifies one access road and one light use road. Map <br />15, Surface Support Facilities and Structure identifies an additional access <br />road. Information on design, maintenance use, drainage, and reclamtion of the <br />roads has been provided. <br />B. Ponds, Impoundments, Diversions <br />The applicant proposes one sediment pond, Pond E, and several diversions as <br />part of this application. The discussion of ponds and diversions is contained <br />on pages 2.05-13 through 2.05-18 of the permit application and in Exhibit 8, <br />Sedimentation Pond Design. Map 5, Fish Creek Tipple Hydrology and Map 15, <br />Fish Creek Tipple Surface Support Facilities and Structure locate the pond and <br />diversions. <br />Pond E was reconstructed in 1983 to comply with NPDES permit requirements for <br />treatment facilities, however, the pond does not have enough volume to contain <br />the 60% sediment level and the 10 year - 24 hour storm as stated in the text. <br />The pond, to the elevation of the emergency spillway (55.5'), can contain 1.8 <br />acre-feet of storage. Runoff and sediment volumes generated for the 10 <br />year-24 hour storm event total 1.8 acre-feet. This does not leave any <br />additional sediment storage. The following stipulation is necessary. <br />'~ The applicant has requested a small area exemption from sediment control for a <br />~ ~ ni~~ portion of the tipple facilities. The exempted area would make use of a rock <br />7 ~ filter dam and small dump tb collect runoff and filter out sediment. This <br />system is currently being used at the tipple and inspection by Division <br />personnel have shown it to function properly as a sediment filter. This small <br />area exemption is granted. <br />The application was found to be in compliance with the requirements of this <br />section. <br />XVIII. Bonding - Rules 2.05.4(c)(b) and 3 <br />Reclamation costs for the Fish Creek tipple are calculated to be $113,700.00. <br />The Division has determined that this amount will be sufficient to cover the <br />cost of reclamation at the tipple. <br />Pursuant to Rule 2.07.6(2)(j) and 3.02.1(1), the performance bond must be <br />filed with the Division payable to the State of Colorado, before a permit will <br />be issued. <br />XIX. Sealino of Drilled Holes and Underground Ooeninas - Rules 2.05.4(2 <br />The applicant presents plans for sealing monitor wells holes after they are no <br />longer needed on page 2.05-53. The application is in compliance with this <br />section. <br />
