Subsidence -Rules 2.05.6(6) and 4.20 <br />No underground mining is proposed in the permit application and therefore the <br />requirements of this section are not applicable. <br />XXI. Special Categories of Mining - Rules 2.06, 4.22 through 4.29 <br />Except for Rules 2.06.6 and 4.24, Surface Coal Mining and Reclamation <br />Operations on Areas, or Adjacent to Areas, including Alluvial Valley Floors, <br />the requirements of this section are not applicable to the Fish Creek Tipple <br />permit application. Alluvial Valley Floors are discussed in Section VII of <br />this document. <br />XXII. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4,21 and <br />.30 <br />No problems were identified with respect to the requirements of any of these <br />sections during the review. Based on information provided in Volume 1 of the <br />application, the proposed operation is in compliance with the requirements of <br />this section. <br />XXIII. Operations on Lands Subject to Limitations or Prohibitions - R <br />2.03.7, 2.07.6 and 2.10 <br />The proposed operation is in compliance with the requirements of these <br />sections and 2.07.6(2)(d) because the permit area is not: <br />a. Within an area designated unsuitable for surface and mining operations: <br />b. Within an area under study for designation as unsuitable for surface <br />coal mining operations; <br />c. On any lands subject to prohibitions of limitations; and <br />d. Within 300 feet measured horizontally from any occupied dwelling. <br />TCC has proposed to permanently relocate a portion of Routt County Road 179, <br />north of County Road 33 in Section 13, Township 5 North, Range 86 West and <br />south of the junction with the TCC haulroad in Section 1, Township 5 North, <br />Range 86 West, as shown on Map No.l. The route of the planned relocation <br />would be that portion of the TCC haulroad between County Road 179 on the North <br />and County Road 33 on the south. All requirements of Rule 2.07.6(2)(d)(iv) <br />have been complied with. A copy of the proposed approval from the Routt <br />County Board of County Commissioners is located in Exhibit B of this <br />document. Based on the information presented by TCC the Division finds that <br />the interests of the public and affected landowners will be protected. <br />The operation is in compliance with the requirements of this section. <br />
