Company to submit a proposed design for rehabilitation of the Sylvester Gulch stream channel. <br />This submittal should be in the form of an appropriate revision submitted to the Division no later <br />than September 30, 1997. The revision should address the channel configuration during both the <br />operational and reclaimed phases. <br />STATUS: Complied with 12/05/97 <br />Stipulation No. 65 <br />The Division specifically does not approve additional disturbance to the Sylvester Gulch stream <br />channel as a result of the temporary pipe installation. The Division directs Mountain Coal <br />Company to place the pipe onto the channel bottom without excavation in or near the stream and <br />without constructing a corridor for the pipe as originally proposed in MCC's minor revision no. <br />221 application dated July 11, 1997. <br />STATUS: Complied with 08/19/97 <br />Stipulation No. 66 <br />The applicant must not discharge any water from the drillholes or piezometers proposed for <br />installation with minor revision application no. 226 until all necessary approvals and/or permits <br />have been obtained from the Colorado Department of Public Health and Environment, Water <br />Quality Control Division (WQCD.) The Division is approving the installation of twelve (12) <br />boreholes /piezometers. Once the necessary approvals have been obtained from WQCD, the <br />Division will approve discharge of groundwater to an existing sedimentation pond. <br />STATUS: Complied with 10/8/1997. <br />Stipulation No. 67 <br />Within 60 days of approval of MR-225 MCC must submit revised models for Pond MB-2R. the <br />revised models must reflect the additional disturbed area which will result from [he construction <br />of the water tank topsoil pile.
