IV. SLOPING <br />The proposal to authorize use of the South Fork Pit by GCRB has been posted in the 1~, <br />2"a and 3ra quarter 2006 Schedules of Proposed Actions for the Arapaho and Roosevelt <br />National Forests and Pawnee National Grassland. <br />A scoping letter was sent out to potentially interested or affected parties on May 12, <br />2006. Four responses were received. The Responses were from: <br />• Grand County Road and Bridge: Their response expressed support of the project: <br />• Grand County Department of Planning and Zoning: Their response expressed <br />support of the project, with recommendations, some of which will be incorporated <br />into the permit. <br />• Colorado Division of Minerals and Geology:,They advised that no_materialis_to_ <br />_ be removed from the South Fork Pit until proper permits are obtained from their <br />office. <br />• Mr. James Cowperthwaite: Mr. Cowperthwaite expressed support of the project, <br />but expressed concerns about expansion of the Forest Service road network east <br />of County Road 30. This proposal does not include expansion of the road <br />network, only maintenance of existing roads. <br />V. FINDINGS REQUIRED BY AND/OR RELATED TO OTHER LAWS AND <br />REGULATIONS <br />My decision will comply with all applicable laws and regulations. I have summarized <br />some pertinent ones below. <br />Materials Act of July 31, 1947 (61 Stat. 681. as amended; 30 U.S.C.601-604). This act <br />provides for the disposal of mineral materials on public lands through bidding, negotiated <br />contracts, and Free Use. The National Forest System lands which are occupied by the <br />South Fork Pit were public domain lands, reserved by the National Forest System and <br />designated as National Forest System lands on May 12, 1905. All mineral rights belong <br />to the United States, and mineral materials may be conveyed under the administration of <br />the Forest Service. In accordance with 36 CFR 228.57(d), mineral materials may be <br />disposed of by Free Use to a county road district for use in public projects. Also, in <br />accordance with 36 CFR 228.62(b), the term of a permit may be issued to county road <br />districts for up to 10 years. <br />Forest Plan Consistency (National Forest Management Act) -This Act requires the <br />development of long-range land and resource management plans (Forest Plans). As <br />required by this Act, the Routt Forest Plan was approved in 1997. Because the project <br />area is in a portion of the Sulphur Ranger District previously administered by the Routt <br />National Forest, the Routt Forest Plan was used for guidance. The Forest Plan provides <br />guidance for all natural resource management activities on the Forest. The Act requires <br />that all projects and activities be consistent with the Forest Plan. <br />5 <br />
