Thus this stipulation was <br /> terminated on February 17, 1994 . <br /> Stipulation Nos. 38-49 have been issued as a result of variuos <br /> peritting actions, mostly minor and field revisions and have all <br /> been terminated, except for Stipulation No. 46, which requires TCC <br /> to submit elevation survey information to demonstrate that the prep <br /> plant piers will be below the final proposed postmining grade. <br /> This stipulation is therefore still active. <br /> Stipulations 50-53 were issued as a result or PR-03 . <br /> The active Stipulations to the permit at the time this mid-term <br /> review was conducted are as follows: <br /> STIPULATION NO. 11 <br /> Prior to approval of any mining-related activities which would <br /> potentially affect lands in the North 112 of Section 10, TIN, R86W <br /> or the Southwest 114 of the Southwest 114 of Section 33, T6N, R86W <br /> (through future permit revision or renewal) the permittee will <br /> submit acceptable right-of-entry information to the Division. <br /> STIPULATION NO. 46 <br /> in conjunction with MR-106, TCC will submit survey elevation data <br /> for the piers (or floors) constructed for the preparation plant <br /> foundation to demonstrate they are a sufficient depth below the <br /> final approved post-mining topography to demonstrate that no <br /> additional bond money would be necessary to cover demolition at <br /> final reclamation. <br /> STIPULATION NO. 50 <br /> Permit Revision #3 (PR-03) approval for the Foidel Creek Mine is <br /> conditional upon resolution of the Pittson injunction associated <br /> with the Federal Audit violations VA 940103193 and WV 940121110, <br /> CMIS violation C83-013-106-002 and four (4) AML fines for permit VA <br /> 440558601A. Proof of resolution of these outstanding violations <br /> and fines must be submitted to the Division as soon as it comes <br /> available. <br /> STIPULATION NO. 51 <br /> Prior to entering the private coal owned by Mr. Paul Swisher <br /> located in the SE/4 of Section 28 T5N R86W and in W12 NE/4 of <br /> Section 20 T5N R86W, Twentymile Coal Company will submit the <br /> appropriate documents which demonstrate compliance with Rule <br /> 2.03 .6, Right of Entry and Operation Information. <br /> -8- <br />
