Stipulation No. 32 required TCC to submit the approval documents <br /> from the Colorado Department of Health for the waste water <br /> treatment facility at the main facility area. TCC submitted <br /> approval documents and a Professional Engineer Certification <br /> following construction on September 13, 1993 and October 21, 1993, <br /> respectively. Thus, Stipulation No. 32 was terminated. <br /> Stipulation Nos. 33-37 were attached to the permit as a result of <br /> PR-02, Southwest Mining District. Stipulation No. 33 required TCC <br /> to coordinate and implement a plan for investigation and/or <br /> protection of rock art site 5RT345 prior to undermining. This plan <br /> required approval by the Bureau of Land Management as well as by <br /> the Division. On December 13, 1994, the Division received a copy <br /> of a letter sent to Mr. Rick Mills of TCC from John Husband of the <br /> BLM dated November 25, 1994 authorizing the mine to proceed with <br /> the approved mine plan in the SW Mining District prior to the final <br /> reports being submitted, as all required field work had been <br /> completed at that time. Therefore, Stipulation No. 33 was <br /> terminated effective December 13, 1994 . <br /> Stipulation No. 34 required TCC to submit a copy of their agreement <br /> with the owner of the mobile home to the Division. Thus, <br /> Stipulation No. 34 was terminated on March 25, 1994 . <br /> Stipulation No. 35 required TCC to submit to the Division the road <br /> monitoring and repair plan for that section of County Road #27 <br /> which was to be undermined and subsided as a result of PR-02, SW <br /> Mining District. On March 25, 1994 the operator submitted a copy <br /> of the Special Use Permit issued to Twentymile Coal by Routt <br /> County. Specific monitoring and repair plans were included in this <br /> amendment of the existing permit and included plans for the Eastern <br /> Mining District as well . Thus, this stipulation was terminated on <br /> March 25, 1994 <br /> Stipulation No. 36 required TCC to submit to the Division any <br /> agreements with the owners of any structures to be undermined as a <br /> result of mining in Panels 7, 8 and 9 of the Southwest Mining <br /> District. The rail spur was not undermined and the gas well was <br /> owned by Cyprus Western Coal Company and abandoned as per MSHA <br /> regulations. On March 25, 1994, TCC submitted to the Division a <br /> recorded memorandum of a finalized agreement with Mr. Robert Perry, <br /> the owner of the mobile home concerning subsidence of same. Mr. <br /> Perry was relocated to a nearby property outside of the affected <br /> area. Other structures were covered under approved subsidence <br /> control plans (telephone line, powerline) or handled by other <br /> previous stipulations (county road #27) . Therefore, this <br /> stipulation was terminated on March 25, 1994 . <br /> Stipulation No. 37 required TCC to submit appropriate right of <br /> entry for the Federal coal in the Southwest Mining District. On <br /> February 17, 1994, TCC submitted to the Division a copy of the <br /> Mining Plan Approval Document No. CO-0093 for lease COC-53560 in <br /> portions of Section 31, TSN, R86W and Section 36, TSN, R87W, <br /> -7- <br />
