.. <br />a <br />7. Pursuant to the terms of the termination <br />Agreement, Harrison will pay the Division <br />eighteen thousand five hundred dollars <br />($18,500.00). The Division will use those <br />funds to: <br />a. remove the culvert that directs <br />water from the "Unnamed Creek" into the Magpie <br />Diversion the West Pit sediment pond. and <br />embankment. <br />c. reclaim anv areas disturbed in <br />conjunction with removal of the culvert and <br />sediment pond or construction of the drainaae <br />channels. <br />2. Your second comment concerned engineering designs and <br />references to a map enclosed with an earlier field directive. <br />The statement referring to an enclosed map which did not <br />represent an engineering design was intended simply as an <br />acknowledgement that the plan view of the west pit and general <br />location of the drainage channels did not include specific <br />engineered design specifications. Those specifications are <br />included in the field directive which would modify the work <br />plan in accordance with the revised designs discussed in David <br />Berry's memo. <br />The proposed design for the West Pit drainage is based upon <br />recognized professional standards and published data. Item 8 <br />of the original agreement is no longer appropriate since the <br />bid for the work has been awarded. The same intent could be <br />retained if the language in the existing agreement is revised <br />to read, <br />Document RN-COAL-MINES-8 and attached man: and <br />
